FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Greens at Collindale Replat is subject to administrative review and the
requirements of the Land Use Code (LUC).
B. The Greens at Collindale Replat conforms to standards of the RL zoning district.
C. The Greens at Collindale Replat conforms to the applicable plat standards as put
forth in the Land Use Code.
D. Future development of the property will be required to meet Land Use Code
Division 2.6 DEVELOPMENT CONSTRUCTION PERMITS; and, Division 2.7
BUILDING PERMITS.
E. Given the proposed lot dimensions and resulting driveway lengths, conflicts may
occur between pedestrians using the adjacent sidewalks and vehicles parked off-
street.
DECISION
Based on the findings and conclusions, the request for The Greens at Collindale
Subdivision is approved with the following condition:
As part of the Greens at Collindale minor amendment application dated August
1, 2000, the Applicant shall add the following note to the Final Site and
Landscape Plans stating that "off-street parking shall be prohibited within
driveways with less than nineteen feet in length, as measured between the back
edge of the sidewalk and the face of the garage door"
Dated this 1 st day of November 2000, per authority granted by Sections 1.4.9(E) and
2.1 of the Land Use Code.

shall be permitted until the subdivision plat is filed and recorded in the City of
Fort Collins.
B. The replat is in compliance with Section 3.3.1(B) Lots in that:
1) With this replat, each lot continues to have at least the same amount of area
as with the original Greens at Collindale P.U.D. Each lot has direct vehicular
access to a public and the side lot lines are substantially at right angles or
radial to the street lines.
2) The general layout of lots, roads, driveways, utilities, drainage facilities and
other services within the proposed development accomplishes the purposes
of the intent of the Land Use Code at least to the extent of the original P.U.D.
approval.
C. The replat is in compliance with Section 3.3.1(C) Public Sites, Reservations
and Dedications in that:
1) The rights -of -way for the adjacent street (Lemay Avenue) and the drainage
and utility easements necessary to serve the site were dedicated with original
Greens at Collindale P.U.D. plat that is on record in the City of Fort Collins.
The reconfigurations of the lots and tracts change the shapes of the
necessary access, utility, and drainage easements. The new easement
configurations continue to adequately serve the access, utility, and drainage
needs.
4. Findings of Fact/Conclusion:
A. The Greens at Collindale Replat contains a permitted use in the RL - Low
Density Residential Zoning District.
B. The Greens at Collindale Replat meets the procedural requirements located in
Division 2.1 - General Procedural Requirements, Division 2.2 - Common
Development Review Procedures for Development Applications, and Section 2.4
- Project Development Plan located in Article 2 - Administration.
C. The Greens at Collindale Replat meets the plat requirements located in Section
3.3.1 - Plat Standards located in Article 3 - General Development Standards.

COMMENTS:
1. Background:
The zoning and land uses that surround the Greens at Collindale P.U.D. are as follows:
N: RL; existing Warren Park,
POL; existing Collindale Golf Course,
S: RL; existing residential neighborhood (Golden Meadows),
W: RL; existing single-family residential (Harbor Walk Estates),
E: POL; existing Collindale Golf Course.
This property was annexed into the City as part of the "Warren Lake Annexation and
Zoning" on April 21, 1987.
2. Article 2 - Administration:
The request complies with the applicable requirements of the LUC, specifically the
procedural requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 - Administration.
3. Article 3 - General Development Standards:
The request complies with the applicable requirements of the LUC, specifically the plat
requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
A. The replat is in compliance with Section 3.3.1(A) General Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in writing
on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for construction
of any new principal building or no act which changes the use of any building

NOTICE OF PUBLIC HEARING: Notice of public hearing was made on October 9,
2000 by mailing to property owners within 500 feet of
the subject property.
The public hearing was advertised in the Coloradoan.
PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 5:30 PM on October 23, 2000. The hearing was held in
Conference Room A at 281 North College, Fort Collins, Colorado.

The Greens at Collindale P.U.D. is a 6.42 acre residential development originally
consisting of 33 single family attached lots. This proposed replat would reconfigure the
P.U.D. into 32 lots. Housing on Lots 9, 10, 11, 12, 25 and 26 will continue to be single
family attached units, while the remainder of the site will permit single family detached
units.
