Findings of Fact/Conclusion: A. The Greens at Collindale Replat contains a permitted use in the RL - Low Density Residential Zoning District. B. The Greens at Collindale Replat meets the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. C. The Greens at Collindale Replat meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. RECOMMENDATION: Staff recommends approval of the Meadows at Greens at Collindale Replat, file # 8-96B. Greens at Collindale, Replat — File #8-96B October 23, 2000 Administrative Hearing Page 3 A. The replat is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) No building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the use of any building shall be permitted until the subdivision plat is filed and recorded in the City of Fort Collins. B. The replat is in compliance with Section 3.3.1(B) Lots in that: 1) With this replat, each lot continues to have at least the same amount of area as with the original Greens at Collindale P.U.D. Each lot has direct vehicular access to a public and the side lot lines are substantially at right angles or radial to the street lines. 2) The general layout of lots, roads, driveways, utilities, drainage facilities and other services within the proposed development accomplishes the purposes of the intent of the Land Use Code at least to the extent of the original P.U.D. approval. C. The replat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) The rights -of -way for the adjacent street (Lemay Avenue) and the drainage and utility easements necessary to serve the site were dedicated with original Greens at Collindale P.U.D. plat that is on record in the City of Fort Collins. The reconfigurations of the lots and tracts change the shapes of the necessary access, utility, and drainage easements. The new easement configurations continue to adequately serve the access, utility, and drainage needs. Background: The zoning and land uses that surround the Greens at Collindale P.U.D. are as follows: N: RL; existing Warren Park , POL; existing Collindale Golf Course, S: RL; existing residential neighborhood (Golden Meadows), W: RL; existing single-family residential (Harbor Walk Estates), E: POL; existing Collindale Golf Course. This property was annexed into the City as part of the "Warren Lake Annexation and Zoning" on April 21, 1987, The Greens at Collindale P.U.D. is a 6.42 acre residential development originally consisted of 33 single family attached lots. This proposed replat will reconfigure the P.U.D. into 32 lots. Lots 9, 10, 11, and 12 will continue to be single family attached, while the remainder of the site will become single family detached lots. 2. Article 2 - Administration: The request complies with the applicable requirements of the LUC, specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. 3. Article 3 - General Development Standards: The request complies with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. Stuart, #4203 Fort Collins, CO 80525 PROJECT DESCRIPTION: The applicant wishes to eliminate lot 23 of the original P.U.D, and reconfigure the size and shape of 19 other lots within the P.U.D. The original Greens at Collindale P.U.D. was designed as single family attached housing in duplex configurations. The reconfigured lots will be generally larger and will now only allow single family detached housing to be built. RECOMMENDATION: Approval EXECUTIVE SUMMARY: This request complies with the applicable requirements of the Land Use Code L( UC), specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Division 2.4 - Project Development Plan located in Article 2 - Administration; and Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards.
