I hereby certify that this Subdivision Plat has been duly executed as
required pursuant to Section 2.2.3(C)(3)(a) through (e) inicusive of the Land Use
Code of the City of Fort Collins (except to the extent that such execution has
been waived/modified by the Director of Community Planning and Environmental
Services of the City) and that all persons signing this Subdivision Plat on behalf
of a corporation or other entity are duly authorized signatories under the laws of
the State of Colorado. This Certification is based upon the examination of the
records of the Clerk and Recorder of Larimer County, Colorado as of the date of

urgent need to complete the improvements to 4th Street. However, the City feels that in the near
future, improvements to this street will likely happen, which is why the City is requiring you to escrow
the amount of "your portion" of the public improvements.
Each development project that is submitted to the City for approval is required, by City code, to
improve the public ROW adjacent to their property or escrow such funds so as to complete the
Developer" required improvements at a later time. Please refer to Section 24-95(a) and (b) of the
City Code (Exhibit "C"). Understand that City staff is not isolating this project from others currently
being reviewed. This requirement is placed on all proposed developments within the City.
I hope this clarifies any concerns you had with this issue. Should you have any further questions,

Re: Escrow for Future Improvements to 4th Street (Hemlock Street)
Dear Mr. Meserlian,
In response to our meeting on May 3, 2000, 1 am writing this letter to address the concerns you have
with escrowing funds for future improvements to 4th Street (Hemlock Street). As we discussed
during our meeting, I brought this issue to our Transportation Coordination meeting this morning.
I explained to City staff your concerns and provided them with a copy of your letter dated May 3,
2000.
Upon reviewing the information, you have provided, City staff is recommending that money be
escrowed to the City for the "future improvements" to 4th Street (Hemlock Street). This money will
need to be in the form of a letter of credit or any other City approved means of security. Said
security shall be submitted and approved by the City Engineer prior to the issuance of the
Development Construction Permit (DCP).
City staff has determined that the need to improve 4ih Street in the future is necessary. It will be your
responsibility to supply the City with an estimate describing the cost to improve 4th Street to the
City's current street standards adjacent to your property. This estimate will need to be completed
by a licensed professional engineer registered in the state of Colorado. For your information 4th
Street is classified as an Industrial Local Street. Your engineer can refer to the City's street
standards for the proper lane widths, sidewalk requirements, etc.
I would also like to take a moment to discuss why the City is requiring this development to escrow
such funds. On February 5, 1999, the Current Planning Department sent you a letter (Exhibit "A")
addressing the comments and concerns stated at the Conceptual Review meeting. In that letter,
it states that "you may be required to improve Hemlock Street". This issue was also addressed in
the Development Agreement associated with Levon's Minor Subdivision (Exhibit "B"). Please refer
to Section II.D.2 of that document, which says "The Developer shall be obligated for the design and
construction costs for the local street portion of 4th Street improvements along the frontage of this
development at the time the City deems improvements to this street are necessary." Granted these
documents talk about improving 4th Street immediately, but at the present time, there is not an

volume and generate a new stage -storage chart with the revised 100-year
HWL.
b. This is the only comment from Stormwater that Current Planning received
by May 18, 2001. Since Troy Jones will be out of the office the week of
May 21', and all departments have until May 23'd to formalize written
comments, there may be more Stormwater comments forthcoming. Troy will
be back in the office on May 291h, and if more comments were received, he
will forward them on to you at that time.
4. Zoning Department
a. Landscape Plan: I would still like to see the landscape plan cleaned -up for
ease of reading, inspecting and any future development that might take
place out there. It is jumbled and unclear.
b. Light Fixtures: The light fixture options need to be part of the plans, not
separate sheets. Can be shown on building elevations sheet.
5. Traffic Operations
a. No Comments with the office/warehouse use.
6. Transportation Planning
a. Sidewalk: A sidewalk is required in the long narrow landscape area between
the existing parking and the row of parking labeled "phase 2 parking" on the
site plan.

and door treatment are the primary issues. Again, the school discussions will
not affect this office/warehouse application, but should be resolved as soon
as possible.
c. Type 1 hearing: We are almost ready for a hearing. 5tormwater's issue
regarding the existing pan's capacity limitations is the only issue holding the
project up from going to hearing.. It is my understating that it can either be
addressed by upsizing the on -site detention, or by installing a bigger pan
(see detailed Stormwater comments for specifics). Work with stormwater
on this issue during the week of May 21st as I will be out of the office all
that week. From a timing issue, if you work out the issues with Stormwater
while I'm gone, I can schedule the hearing date as soon as I return. This
would translate into a possible hearing date of June 12th through 15'h
d. Project Name: This project is not a minor subdivision like the first building
was. This is a Project Development Plan (P.D.P.) The official name of the
project is "Levon's 2nd Warehouse and Office Building P.D.P." Make sure
the term "P.D.P." is included in each title block and across the main title line
of the plat and utility plans. The project must be named as such on the site
plan, landscape plan, elevations, plat, and utility plans. The plat's title needs
to be changed to be "Plat of Levon's 2nd Warehouse and Office Building
P.D.P. Being a Replat of Lot ......... Revise the titles accordingly.
e. Attorney's Certification: When you bring in the mylars, you need to change
the Attorney's Certification signature block language to that shown on the
attached sheet. Because you were granted a modification to this project,
this signature block is slightly different than the one you are using.
f. Planning and Zoning Signature Block on Plat: Remove the Planning and Zoning
signature block from the plat. It is the wrong signature block. Instead, use
the "Director of Planning" signature block. Please see the attached sheet
with an example. I don't need to see this as a revision, just make sure that
when you bring in the mylar, that this issue is fixed.
g. Signature Blocks on the Site Plan: Rather than the Owner's Certification
block and the Attorney's Certification block that you currently have on the
site plan, use the attached "Director of Planning" and the attached "Owner's
Certification" signature blocks (including the notary portion) from the
attached sheets. There is no need for an attorney's certification on a site
plan. Just make sure these changes are made on the mylars when you bring
them in.
3. Stormwater Department
a. Detention Pond -The detention pond volume calculated for the difference
between the 13.51 cfs and 9.98 cfs includes the water quality capture
volume. City of Fort Collins requires that this volume be in addition to the
water quality volume. Please add the required storage for this additional

Staff has reviewed your submittal for Levon's 2nd Warehouse and Office Building
P.D.P, and we offer the following comments:
COMMENTS:
Not all comments have been received yet: I have not received formal comments
from the following departments and agencies that were routed copies: Advance
Planning, Quest, Public Service, AT&T, Water/Wastewater. If and when I
receive comments from said sources, I will forward them on to you.
2. Current Planning
a. Hemlock Street: Work out the escrowing of funds for future Hemlock
improvements with Dave Stringer in Engineering. This issue will need to be
addressed in the Development Agreement.
b. Possible School: Although a school is not formally part of this application, if
there is any chance you will be requesting to make it such at some point in
the future, we should begin to work out the issues for such a request sooner
rather than later. We can keep the office/warehouse application a separate
application while starting to discuss the upcoming school application
concurrently. The last thing we want to happen is for the school to have
made commitments on a move -out date for their current location, but not
have anywhere to move into at that time. We need to set up a meeting with
Transportation Planning, Traffic Operations, Engineering, Advance Planning,
Current Planning, representatives of the school, and the developer's team to
discuss the issues related to retrofitting a school use. The sooner we begin
to discuss the issues, the sooner we can come up with solutions, and the
better our chances will be at accommodating the school's timing needs. The
City comments you received dated 3/30/01 begin to lay out the issues that
will need to be resolved for the school use. In a nut shell, drop-off/pick-up
of the children, traffic circulation, safe, dry play areas, and building window
