HomeMy WebLinkAboutHARVEST PARK SUBDIVISION, 5TH FILING - REPLAT OF BLOCKS 3 & 4 - 25-98H - CORRESPONDENCE - RESPONSE TO CITIZENCommt.._..y Planning and Environmental , .fvices Current Planning City of Fort Collins October 16, 2003 Participant in the Harvest Park Subdivision, 5"' Filing, PDP Public Hearing: This letter is to inform you of two distinct actions: (1) the Hearing Officer decision for the Harvest Park Subdivision, 5`' Filing, Project Development Plan #25-98H; and (2) the staff decision for the Minor Amendment application to change the use of blocks 3 and 4 of Harvest Park First Filing from 36 single family detached units to 40 single family attached units. Enclosed is a copy of the Type I Administrative Hearing Findings, Conclusions, and Decision for the Harvest Park Subdivision, 5�' Filing, Project Development Plan #25-98H, and a copy of the Minor Amendment decision. This final decision of the Harvest Park Subdivision, 5" Filing PDP may be appealed to the City Council in accordance with Section 2-48 of the Code of the City of Fort Collins, however the final decision of the Minor Amendment may be appealed to the Planning and Zoning Board in accordance with Section 2.2.10(A)(4) of the Land Use Code. In either case, an appellant must submit written notice of appeal, a description of the grounds for the appeal and a filing fee of $100 to the City Clerk's Office within 14 days of the date of final action by the Hearing Officer. Information regarding the grounds for appeal is available on the City Clerk's page of the City's website at http://fcgov.conVcityclerk/appeals/oho. If appealed, the City Clerk will, as expeditiously as possible, place the item on the Council agenda for hearing if it's an appeal of the Hearing Officer decision, or place the item on the Planning and Zoning Board agenda if it's an appeal of the Minor Amendment decision. Written notice of an appeal is given to the appellant, the applicant and all other parties -in -interest 10 days prior to the date set for the hearing. An appeal of the Hearing Officer's final decision is based on the minutes of the proceedings at the Administrative Hearing and any other materials received by the Hearing Officer.
