April 7, 1999 — Ballot Initiative submitted to voters (in the City only) to Overturn City
Council Resolution denying Mulberry — Lemay Crossings, Preliminary P.U.D. (with Staff
conditions) — Initiative passes. Preliminary P.U.D. with Staff conditions now approved.
January 20, 2000 — Mulberry — Lemay Crossings, Filing One, Final P.U.D. — approved by
the Planning and Zoning Board.
March 28, 2000 — Mulberry — Lemay Crossings, Filing One, Final P.U.D. Appeal to
Council — Council upholds P&Z approval.
Utility Plans modified to accommodate round -about intersection.
Utility Plans modified to revert back to a typical intersection.
November 20, 2000 — Building Permit issued for Wal Mart. Building permit fees paid
$1,593,922.22 The Street Oversizing Fee, by itself, equals $1,236,433.90. (Fees do not
include Erosion Control Escrow, Developer's obligation for local street improvements,
and Developer's cash -in -lieu for off -site bicycle -pedestrian path/bridge over the Poudre
River - $200,000, and off -site drainage improvements.)
Temporary Certificate of Occupancy (with conditions) issued October 17, 2001.

CHRONOLOGY
Irrigated Agriculture — Harold Fisher.
Annexed in two phases:
A. Southerly 12 acres in 1984
B. Northerly 39 acres in 1995 (Wal Mart and Buffalo Run Apts.).
Spring of 1994 — Goldberg Properties Associates enters into a negotiation for a parcel of
land in the Harmony Corridor controlled by the General Motors Pension Fund for a Wal-
Mart Superstore.
June of 1994 — Council adopts six-month moratorium on commercial and retail
development in the Harmony Corridor.
December of 1994 — Council adopts Standards and Guidelines for Large Retail
Establishments (Big Box).
January of 1995 — Council adopts the Amended Harmony Corridor Plan firmly
establishing the location and scale of retail centers within the Harmony Corridor along
with Standards and Guidelines regulating development.
January of 1997 — Council adopts Transition Ordinance addressing how to transition
projects in progress from the Land Development Guidance System to the new Land Use
Code.
March 24, 1997 — 51-acre Overall Development Plan approved (thereby complying with
one of the deadline requirements in the Transition Ordinance and successfully being able
to stay under the jurisdiction of the L.D.G.S.).
March 27, 1997 — Application for Mulberry — Lemay Crossings Preliminary P.U.D. (43
acres, 339,072 square feet) received by Current Planning. By submitting no later than
this day, application is reviewed under the L.D.G.S.
March 27, 1997 — Council adopts new Land Use Code.
October 2, 1997 — Buffalo Run Apts. Final P.U.D. approved.
November 5, 1998 - Preliminary P.U.D. (with Staff conditions) denied by the Planning
and Zoning Board 4 — 3.
December 15, 1998 — Appeal to Council Public Hearing — Upheld the P&Z denial 4 — 3.
