Step 5: Recording Fees
After approval of the vacation by the City Council or the Planning and Zoning Board, the applicant
will be asked to submit a check to the Development Review Center, payable to the "Larimer County
Clerk and Recorder" to cover the cost of recording the vacation documents. The current cost is $5.00
per page.
Note: If a property is in the process of being replatted, the vacation of easements should be made on
the plat. Right-of-way vacations associated with replats must be approved by City Council after
approval and filing of the replat and will take approximately 8 weeks to complete.

Vacation of
Rights -of -Way and Easements
A request for vacation of easements or rights -of -way may be submitted to the Development Review
Center at any time. The processing time for a routine vacation request is approximately 8 weeks. The
following procedure should be followed in vacating a public right-of-way or easement:
Steo l: Application
An application is filed with the Development Review Center at any time, containing the following
information:
A. A written request with details describing the proposed vacation and justification of why the
proposed vacation is necessary. .
B. A sketch that accurately shows the proposed vacation.
Steo 2: Routing for Comments
The Development Review Center staff routes the vacation request to relevant City departments and
public agencies for their review. Approximately 2 weeks later, the review comments are returned to
the Development Review Center and a recommendation is made by the staff on the request. The staff
of the Development Review Center will contact the applicant to discuss these comments and the
recommendation. Additional information to support the request may be required.
Steo 3: Legal Description
If City staff supports the request for vacation, the applicant shall be required to submit a legal
description of the proposed vacation prepared by a licensed land surveyor.
Steo 4: City Council or Planning and Zoning Board Consideration
Upon receipt of the legal description, the Development Review Center staff will prepare a written
report for City Council (for right-of-way vacations) or Planning and Zoning Board (for easement
vacations). City Council will consider an ordinance for the vacation request and approve or deny the
request on first reading. If approved on first reading, the City Council considers the second reading
of the vacation ordinance at their next regularly scheduled meeting. City Council meets on the first
and third Tuesday of every month. If the ordinance is approved on second reading, it becomes official
after the tenth business day following approval on second reading and upon filing of the ordinance
with the Larimer County Clerk and Recorder. Vacation of an easement requires approval of a
resolution (which requires only one reading) by the Planning and Zoning Board. If the Planning and
Zoning Board approves the easement vacation, it becomes official upon recording of the resolution
with the Larimer County Clerk and Recorder.

• Two different easements (a 10 foot utility easement and a 20 foot non
vehicular access easement) exist along the property boundary of Riverside
Ave where the drive-thru lanes are being shown. The parapet roof over these
easements would not be allowed. It is a possibility that the easements could
be vacated. That is a decision that is up to the various utilities departments.
Attached is a handout on easement vacations.
• Provide signage and pavement markings to indicate the direction of flow thru
the drive-thru.

C. The elevations indicate that a portion of the parapet wall on the top of the building is
to be removed. All roof top mechanical equipment must remain screened from the
public view.
d. Additional landscaping is needed along the north (Riverside) side of the drive-thru
lane as the drive-thru facility is being intensified.
This completes the review comments at this time. Additional comments may be forthcoming as the
various departments and reviewing agencies continue to review this request.
Staff will schedule an Administrative Hearing with the Director of Planning for this request after
receipt and review of revised plans which address these comments. Please contact me at 221-6206

Staff has reviewed your documents for the Farmers Bank at Riverside Shopping Center (Change of
Use Review), that were submitted on May 2, 1996, and would like to offer the following comments:
The Zoning Department offers the following comments:
a. Please show the distance of the drive-thru "cover" to the property line.
b. Please dimension the length of the drive-thru "cover".
2. The Transportation Department stated that the drive-thru lane is too narrow (14' feet ) and
must be modified.
3. Comments from the Engineering Department are attached.
4. The Water and Wastewater Utility offers the following comments:
a. Please show the locations of any water and sanitary sewer services (including
irrigation services) on the Sit&lmdscape Plan.
b. Please show any water/sewer mains and easements on the Site/Landscape Plan.
5. The Current Planning Department offers the following comments:
a. The Elevations reference that the building is to be painted - "Color to be approved by
the City of Fort Collins." Please indicate existing and/or proposed building materials
and proposed colors on the Elevations.
b. Please provide an elevation of the proposed (future) ATM building.
