Additional comments may be forthcoming as the various departments and reviewing agencies continue to review this request. In order to stay on schedule for the July 22, 1996 Planning and Zoning Board hearing, please note the following deadlines: Plan revisions are due by 12:00 p.m. on Wednesday, July 3, 1996. P.M.T.'s and 10 folded prints are due by 12:00 p.m. on Monday, July 15, 1996. Sincerely, Mitchell Haas, Project Planner 4. Please add the following note: "If 1002 Akin Avenue is sold or otherwise transferred (i.e., leased), off-street parking for the business at 217 S. Mack Street will need to be accommodated on site; this will require submittal and approval of an Administrative Change to this PUD." Note #3 is incorrect. A Certificate of Occupancy (C.O.) will be required due to the change of use, as per the Zoning Code. Occupancy Group designation under the Building Code does not change, but that does not mean that a new C.O. will not be needed. Rather, a new C.O. will definitely be required. If you have any questions regarding this comment, please contact Peter Barnes, Zoning Administrator, at 221- 6760. 6. Please add the following note: "A new Certificate of Occupancy will be obtained from the Fort Collins Building Inspections Department prior to implementation of the change of use." Please add the following note: "The kitchen used for the catering operations will meet the standards and requirements of the Larimer County Department of Health." 8. Please add the following note: "The facility will not be open to the public; all products prepared will be transported to other businesses." Please add the following note: "A ten (10) pound ABC fire extinguisher, placed twenty (20) feet from the cooking area, will be installed/mounted on the wall." C. Other Site Plan Comments: As long as the warranty deed is left on the site plan, it is not necessary to provide a legal description. That is, a legal description is contained in the warranty deed, and duplication of this information is not necessary. OTHER/GENERAL COMMENTS - - - The City's Water and Waste Water Department has requested that you please volunteer to receive a water meter; if you volunteer, it will be provided free of charge. As was already recommended to you during Conceptual Review, we (the Current Planning Department) suggest that you circulate a letter of intent, describing what you propose to do, in order to obtain the signatures and, thus, the approval of your neighbors. This would be extremely helpful in persuading the Planning and Zoning Board to approve your proposal. The Engineering Department would like to note that an increase in the scale/intensity of the catering business will require improvements to the alleyway (i.e., paving). June 14, 1996 Mrs. Carol J. Carroll 1002 Akin Avenue Fort Collins, CO 80521 Dear Carol, Staff has reviewed your submittal for the Victorian Tea Catering Kitchen PUD, Preliminary and Final, #15-96, and offers the following comments: I. - - - SITE PLAN COMMENTS - - - A. Plan Comments: The site plan must also show the property at 1002 Akin Avenue, for you are requesting to count the driveway at 1002 Akin as the second off-street parking space. Please show both properties, in their entirety, on the site plan, including existing structures and landscaping. 2. The measurements and/or scaling of the drawing appears to be slightly inaccurate. Please double-check all measurements, and correct any discrepancies found. 3. Please show the location of existing water and sewer lines. B. General Notes Comments: Please change note #1 to read as follows: "Other than the owner, only one employee will be permitted. Only one off-street parking space is being provided on the lot, as the owner resides next door and walks to location/work." 2. Please change note 42 to read as follows: "The change in use is from a single-family rental to a double use provision: catering or residential (either/or provision which will allow the house to convert from one use to the other)." Please add the following note: "Any sale or other transfer (i.e., lease) of the property/properties (217 S. Mack Street and/or 1002 Akin Avenue) will cause the use provision of the structure at 217 South Mack Street to revert to single family residential use only; business/commercial operations would no longer be permitted. Violation of the provisions of this note will be considered a zoning violation, subject to the typically associated penalties."
