POLICY AND INFORMATION CONCERNING USE OF
WESTERN AREA POWER ADMINISTRATION TRANSMISSION LINE EASEMENTS
It is the policy of the Western Area Power Administration to operate its
transmission lines in a manner so that an open and free passageway is
maintained. Because of this policy, anyone wishing to construct any facility,
whether above ground or underground, on a Western Area Power Administration
transmission line easement must, prior to construction, file an application
with the Area Manager, P. 0. Box 3700, Loveland, Colorado 80539, to determine
whether the Western Area Power Administration has any objection to the
proposal. If there is no objection, a determination will be made contingent
on the following understanding and agreement:
1. The Western Area Power Administration assumes no liability for injury
or damage to persons or property directly or indirectly resulting from the
use and maintenance of the transmission lines or the use to be made of the
Government easement or any part thereof by you or your assigns.
2. In the event it becomes necessary to reconstruct, repair, or maintain
the transmission lines, you may be required to remove, at no expense to
the Government, any installation which will prevent free and ready access
through, over, and across the easement.
3. All construction on the Western Area Power Administration easement
shall conform to the standards of the National Electrical Safety Code as
found in the latest revision of National Bureau of Standards
Handbook 81. Additional facilities not included in this request, which
may be installed at a later date, will require submission of another
application.
4. Generally, trees shall not be placed on the government easement
because their later growth will interfere with the ope-ation and
maintenance of the powerline and necessitate removal or cutting back.
5- Any plan to alter the soil around, along, or between the poles and
anchors of the transmission line structures, either by removal or filling,
should be included and explained in the application.
6. You will be liable for any and all damage to the Government property
by reason of the work performed or facilities constructed pursuant to your
request and you shall hold the United States harmless from damage or
injury to persons or property arising directly or indirectly from the use
of the easement.
In order to best consider your request, please complete Form LFCA-20 on the
reverse side of this letter, giving all of the pertinent details of your
proposals.

Dear Mr. Haas:
With regard to the proposed Third Replat of Evergreen Park, Second Filing, located in the
northeast quarter of Section 1, Township 7 North, Range 69 West, 6th P.M., City of Fort Collins,
Larimer County, Colorado, our comments are as follows:
All construction activities on the United States easement should be coordinated with this
office. A copy of an "Application To Construct Or Install Structure on Government
Easement" form is enclosed.
2. The recorded subdivision plat should plainly show the easement area for Western's Poudre-
Richard's Lake 115-kV Transmission Line as 75 feet wide and clearly state:
"The United States easement is a restricted area and all construction activities
should be coordinated with WESTERN AREA POWER ADMINISTRATION,
P.O. Box 3700, Loveland, CO 80539-3003."
3. To avert continual severe pruning and eventual removal of tall growing trees, only low
growing plants are allowed on the easement area.
4. No buildings are allowed within the easement area.
