MEMORANDUM

RE: Proposed Development at 525 S. Taft Hill Road
The purpose of this memo is to follow up on comments that I made at Conceptual Review on
August 19 about the status of property at 525 S. Taft Hill Road that was formerly contaminated
by petrochemicals.
The prospective buyer of the site, Ed Schneider, has a copy of a "tank closure/no further action"
letter from the State to the property owner, Diamond Shamrock Corportation. I have not seen the
letter yet, and need to point out thatthe City is not able to comment on the extent to which a
contractual agreement with the seller will legally protect Mr. _Schneider from liability for
previous contamination.
However, I did talk to Ed LaRock at the State's. Office of Oil Inspection, which has jurisdiction
over the Storage Tank Remediation Process, to get some background information. I have also
spoken with Rich Grossman at the Latimer County Environmental Health Department, who
concurs with the State about the success of the site remediation.
Diamond Shamrock operated a filling station at the site, and a gas leakage was discovered in'
1987. The State approved a corrective action plan in 1992 to remove the contaminated soil and
tanks, and did groundwater monitoring afterward. The State wrote the closure letter in 1994;
they are satisfied that there is nothing more that will migrate off -site.. The groundwater
monitoring wells have been decommissioned.
The City's position is to defer to the State on issues of soil and groundwater contamination.
Therefore, we have no objection to the development of this site for Mr. Schneider's business.
The only suggestions that we would like to make.are for applicant to avoid soil excavation and to
avoid using the site to accumulate solid waste, including old roofing debris.

3. The Light and Power Utility stated that it may be possible for the applicant to tap the
service to the existing building to supply power to the proposed new vehicle storage building.
This would provide adequate service for light switches and outlets. The applicant indicated
that no welding would occur in the vehicular storage building.. Light and Power service will
need to be re-established to the site. Please contact Bruce Vogel at 221-6700 with any
questions regarding these comments.
4. The Poudre Fire Authority stated that if a curb cut on Taft Hill is eliminated, the site must
meet fire access requirements. All exterior walls of any building must be within 1.50 feet of
a single point of access for a fire truck or the buildings must be equipped with an automated
fire suppression system. Please contact Roger Frasco at 221-6570 with any questions
regarding these comments.
5. The Building Inspections Department stated that the proposed use is not classified as a.
change of use or occupancy under the building code. A permit will be required for any new
construction. Please contact Sharon Getz at 221-6760 with any questions regarding these
comments.
6. The Water and Wastewater Utility did not have any comments as no new services and no
changes to existing services are proposed. Please contact Roger Buffington at 221-6685 with
any further questions.
7. Comments from the Natural Resources Department are attached. Please contact Susie
Gordon at 221-6600 with any questions regarding these comments.
8. The Engineering Department stated that the property is located adjacent to an arterial
street. Typically, a single site is not allowed more than one curb cut on an arterial. One curb
cut may need to be deleted. The applicant may want to explore a joint access agreement with
the car wash facility north of this site. A traffic report/study must be submitted with the PUD
Application. The applicant must repair and/or replace any damage curb gutter and sidewalk
along the Taft Hill frontage. The street oversizing fees for potential commercial uses
currently range from $9,722 per acre for building materials to $14,583 per acre for office
uses.. Please contact Matt Baker at 221-6605 to discuss any pro -rating of these fees based
upon the percentage of each use. Additional right-of-way along Tali Hill Road and a 15 foot
utility easement behind -the right-of-way may be required. Utility plans and a development
agreement are will likely be needed. Please contact Sheri Wamhoff at 221-6750 with any
questions regarding these comments.
9. The Current Planning Department restated the Zoning Department's comments that the
office use could be allowed as a use -by -right and that the vehicular storage building would
require a PUD submittal (a minimum 9 week review process): The application" fee for
submitting a PUD on this property is currently $200. Attached is an affected property owner
boundary map. If you choose to submit a PUD for the property, please provide mailing labels
for all property owners within the boundary map and a 50 cent per name notification mailing

Request to convert an abandoned gas/service station to a roofing officelshow room and the potential
addition of a metal building for vehicle storage. The property is located at 525 S. Taft Hill Road
(west side of Taft, south of Mulberry, south of existing car wash).
COMMENTS:
The Zoning Department stated that the property is zoned B-L, Limited Business. Office
uses are permitted as a use -by -right in this zoning district as processed by the Zoning
Department. However, vehicle storage is not permitted as a use -by -right and therefore must
be submitted as a Planned Unit Development (PUD) subject to .the requirements of the Land
Development Guidance System (LDGS) and administered by. the Planning Department. Two
parking spaces for every three employees must be provided. Please contact GaryLopez at
221-6760 with any questions regarding these comments.
2. The Stormwater Utility stated that the property is located in the Canal Importation Drainage
Basin. The stormwater development fees for this basin are $6,181 per acre subject to the
runoff coefficient. The applicant will need to document the amount of existing impervious
surface area on the site. If the increase of impervious surface area for the proposed .re-
development is less than 350 square feet, no.stormwater development fees will be assessed.
A, standard drainage and erosion control report will be required. Please submit
documentation which states that the property is a "clean site", as the soil was contaminated
by the previous use: Please show all drainage easements which may exist. There is an
irrigation ditch.adjacent to the southern boundary of the site. If this ditch has not been
abandoned, the ditch company's signature will be required on development plans. Please
