NOTICE
TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a
Resolution initiating annexation proceedings for the Fort Collins Good Samaritan Village
Annexation, said Annexation being more particularly described in said Resolution, a copy of which
precedes this Notice.
That, on December 17, 1996, at the hour of 6:30 p.m., or as soon thereafter as the matter may
come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins.
Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be annexed meets the
applicable requirements of Colorado law and is considered eligible for annexation. At such hearing,
any persons may appear and present such evidence as they may desire.
The City of Fort Collins will make reasonable accommodations for access to City services,
programs and activities and will make special communication arrangements for persons with
disabilities. Please call 221-6515 for assistance.

Section 2. That the Council hereby finds and determines that the annexation petition and
accompanying map are in substantial compliance with the Colorado Municipal Annexation Act.
Section 3. That the Notice attached hereto, be adopted as a part of this Resolution. Said
Notice establishes the date, time and place when a public hearing will be held regarding the passage
of an annexation ordinance pertaining to the above described property. The City Clerk is directed
to publish a copy of this Resolution and said Notice as provided in the Colorado Municipal
Annexation Act.
Passed and adopted at a regular meeting of the City Council held this 5th day of November,

RESOLUTION 96-133
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE INITIATING ANNEXATION PROCEEDINGS
FOR THE FORT COLLINS GOOD SAMARITAN VILLAGE ANNEXATION
WHEREAS, a written petition, together with four (4) prints of an annexation map, was
heretofore tiled with the City Clerk requesting the annexation of certain property to be known as the
Good Samaritan Village Annexation; and
WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council of the City of Fort Collins hereby accepts the annexation
petition for the Fort Collins Good Samaritan Annexation, which property is located in the County
of Larimer, State of Colorado, and legally described as follows:
A portion of the Southeast Quarter of Section 11, Township 6 North, Range 69 West
of the 6th Principal Meridian, County of Larimer, State of Colorado being more
particularly described as follows:
Beginning at the South One Quarter Comer of said Section 11; said point also being
the Southeast Corner of Fossil Crest Subdivision First Filing according to the plat on
file in the office of the Clerk and Recorder said County; thence along the East line
of said Fossil Crest Subdivision First Filing North 00°56'00" West 30.00 feet to the
TRUE POINT OF BEGINNING; being a point on the North line of Timan First
:annexation according to the plat on file in the office of the Clerk and Recorder said
County; said point also being a point on the North right-of-way line of Trilby Road;
thence continuing along the East line of said Fossil Crest Subdivision First Filing
North 00°56'00" West 960.24 feet to the Southwest Corner of Skyview South Second
Filing according to the plat on file in the office of the Clerk and Recorder, said

Resolution 96-133 Finding Substantial Compliance and Initiating Annexation Proceedings for the
Fort Collins Good Samaritan Village Annexation.

Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation is approximately 15.210 acres in size and is located
at the northwest corner of Trilby Road and Constellation Drive. The Evangelical Lutheran Good
Samaritan Society has voluntarily requested to be annexed into the City of Fort Collins as a 100%
voluntary annexation. The property is currently zoned R-2, Residential, in the County. The
proposed zoning for this annexation is R-L-P, Low Density Planned Residential with a Planned Unit
Development Condition.
The proposed Resolution determines that the annexation petition complies with the Colorado
Municipal Annexation Act. The Resolution also determines that a hearing should be established
regarding the annexation and directs that notice be given of the hearing. The hearing will be held
at the time of first reading of the annexation and zoning ordinances on December 17, 1996.
The property is located within the Fort Collins Urban Growth Area. According to agreements
between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL
AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, (specifically Policy
2.1Oc) the City will agree to consider annexation of property in the UGA when the property is
eligible for annexation according to state law.
The property has 690 feet of its total 3300.48 foot boundary contiguous to existing City limits,
exceeding the minimum of 550.08 feet required to achieve 1/6th contiguity. The annexation consists
of a total 15.210 acres (13.887 acres of privately owned land and 1323 acres of public right-of-way).
The Evangelical Lutheran Good Samaritan Society is the sole owner of the 13.887 acre parcel.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the annexation and zoning request
at its regular monthly meeting on November 25, 1996, and will make its recommendation at that
time. The Board's recommendation will be forwarded to the City Council in time for the First
Readings of the ordinances annexing and zoning the area, scheduled for December 17, 1996.
