Box 1190 Fort Collins, CO 80522-1190 Dear Mr. Helmick: Thank you for your letter dated December 13, 1996 regarding the Good Samaritan.Annexation. The Good Samaritan property is located within the Fort Collins UGA. On January 7, f997 the City Council approved an ordinance accepting the applicant's voluntary annexation to the City pursuant to State Law. Included in this annexation is the entire right-of-way width of Constellation Drive that is adjacent to the Good Samaritan property. This action is consistent with Section 2.10 "Annexations" of the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. Streets being annexed are not required to be upgraded to City Standards at the time of annexation nor prior to the annexation. The City does take over maintenance of the street from the County (in this case, the Skyview Acres South Subdivision). Since Constellation Drive was not constructed to City standards at the time it was built and has not been upgraded to City standards or equivalent, the City will perform minor maintenance including patching potholes trying to keep the street passable. Minor maintenance will be done until the street deteriorates to such a condition that it requires reconstruction. At that time the property owners adjacent to the street will have to pay for the design and construction of the street to upgrade it to City standards. After completion of the construction to City standards and its acceptance by the City, the City will take on full service maintenance (currently includes patching, crack sealing, surface treatments, pavement overlays and pavement reconstruction). The process available to upgrade a street is either an improvement district or a voluntary construction project. With the improvement district, property owners are given the option to pay off their share in one payment when the construction is completed or pay their share in equal payment over 10 or 15 years plus interest and other district costs. At the time the applicant submits a development application for the Good Samaritan property, the City will require a Traffic Impact Analysis. This study will identify any on -site and off -site improvements that are needed to the surrounding street network as a result of the proposed development. 281 North College Avenue • P.O. Further discussions regarding improvement districts or other mechanism which could address the funding of design, construction, and maintenance of roads in this area are needed.
