the plat requirements located in Section 3.3.1 - Plat Standards located in
Article 3 - General Development Standards.
RECOMMENDATION:
Staff recommends approval of the Drake Crossing Shopping Center, Filing No. 2
- Subdivision - #35-96B.
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that:
1) The lots have direct vehicular access to public streets (South Taft Hill
Road, West Drake Road, Valley Forge Avenue, and Hampshire Road),
and the side lot lines are substantially at right angles or radial to the
street lines.
2) The general layout of lots, roads, driveways, utilities, drainage facilities
and other services within the existing development have been
previously established with the shopping center.
C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites,
Reservations and Dedications in that:
1) An applicant shall be required to dedicate rights -of way for public
streets, drainage easements and utility easements as needed to serve
the area being platted. The right-of-way for Hampshire Road, adjacent
to the Drake Crossing Shopping Center, was dedicated with the
subdivision plat for the shopping center. The rights -of -way for South
Taft Hill Road, West Drake Road, and Valley Forge Avenue were
previously dedicated on subdivision plats for contiguous
developments. The drainage and utility easements necessary to serve
this portion of the shopping center will be dedicated with the Drake
Crossing Shopping Center, Filing No. 2 subdivision plat, if approved
and filed.
2) Reservation of sites for flood control, open space and other municipal
uses shall be made in accordance with the requirements of this Land
Use Code. The necessary drainage easements are being dedicated
with the Drake Crossing Shopping Center, Filing No. 2 - Subdivision
request.
5. Findings of Fact/Conclusion:
A. The Drake Crossing Shopping Center, Filing No. 2 - Subdivision contains
permitted uses in the NC — Neighborhood Commercial Zoning District.
B. The Drake Crossing Shopping Center, Filing No. 2 - Subdivision meets
the procedural requirements located in Division 2.1 - General Procedural
Requirements, Division 2.2 - Common Development Review Procedures
for Development Applications, and Section 2.4 - Project Development
Plan located in Article 2 - Administration.
COMMENTS:
1. Background:
The surrounding zoning and land uses are as follows:

Farm)

existing residential (Heinemann's Spring Creek Subdivision,
Hampshire Pond, Hampshire Pond East)

existing residential (Hampshire Court, Hampshire Square)

existing church and residential (Fort Collins Bible, Lexington
Green)
The property is part of the Brown Farm First Annexation that was approved by
City Council in June, 1971.
The subject property was platted and planned as part of the Drake Crossing
Shopping Center Planned Unit Development in March, 1982.
2. Purpose of the Subdivision:
The purpose for the replat of a portion of the Drake Crossing Shopping Center
Subdivision is to create three lots on a property that presently is a tract of land
and an access, utility & drainage easement on a portion of a previously
subdivided property. The 3-lot subdivision plat will create three lots, one being
5.24 acres in size (Lot 1), the second being 4.18 acres in size (Lot 2), and the
third being 1.54 acres in size (Lot 3). Staff has determined that there is no
detriment to the existing development associated with the platting of the three
lots.
3. Article 2 - Administration:
The Drake Crossing Shopping Center, Filing No. 2 - Subdivision complies with
the applicable requirements of the LUC, specifically the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications, and
Section 2.4 - Project Development Plan located in Article 2 - Administration.
4. Article 3 - General Development Standards:
The Drake Crossing Shopping Center, Filing No. 2 - Subdivision complies with
the applicable requirements of the LUC, specifically the plat requirements
located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.

PROJECT DESCRIPTION:
This is a request to replat Tract Wand an Access, Utility & Drainage Easement
on the existing Drake Crossing Shopping Center subdivision plat into three lots,
one being 5.24 acres in size, another being 4.18 acres in size, and the third
being 1.54 acres in size. The site is currently developed, being the Drake
Crossing Shopping Center (First National Bank Plaza) that contains a Safeway
Supermarket, a Walgreens Drug Store, and various other retail, personal service,
and office uses. The property (shopping center) is located at the northwest
corner of South Taft Hill Road and West Drake Road. It is in the NC —
Neighborhood Commercial Zoning District.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
This request to create a 3-lot subdivision plat for a property that presently is
Tract `A' and an Access, Utility & Drainage Easement of the Drake Crossing
Shopping Center complies with the applicable requirements of the Land Use
Code (LUC), specifically the procedural requirements located in Division 2.1 -
General Procedural Requirements, Division 2.2 - Common Development Review
Procedures for Development Applications, and Division 2.4 - Project
Development Plan located in Article 2 - Administration; and Section 3.3.1 - Plat
