sites may have to be reconfigured and the sidewalk would probably have to be torn out.
It would be a significant cost. He did commit to fulfilling what was approved on the
Preliminary PUD, which is the sidewalk connection.
Member Gavaldon asked it they could put in a temporary asphalt segment that goes north
and south that could be ripped out when the outcome of the pad sites has been
determined.
Mr. Goldberg stated they could do that.
Member Gavaldon moved for approval of the Mulberry Lemay, Filing 2, Final P.U.D.,
#36-96E with the condition that a temporary north south asphalt sidewalk be
included with the this development for a temporary measure for pedestrians to
connected to the centerline of Phase 2.
Member Meyer seconded the motion.
Member Gavaldon thanked Mr. Goldberg for being flexible and he felt that the efforts on
drainage and traffic were good. He would be supporting the project.
Member Craig stated she would not be supporting the project. She referred to A2.1, it is
something that is not required of the developer, but she has a real problem with taking the
arterial, which is Lemay, and bottlenecking it down to a minor arterial, even though the
traffic is going to be beyond a minor arterial capacity and putting it in front of the houses
of Alta Vista.
Chairperson Colton stated that he would be supporting the project even though he still
has concerns about Lemay and Vine. He hopes that Mr. Bracke is right and the
intersection will be acceptable for a number of years to come.
The motion was approved 6-1 with Member Craig voting in the negative.

Planner Shepard replied that when the pad sites come in that is when we would expect
those improvements to be made.
Member Gavaldon asked about improvements to the Vine and Lemay intersection.
Eric Bracke, Transportation Department responded that the project will remain a high
priority in the capital improvements planning for the next round. From the Transportation
Service Area it is one of the top priorities.
Member Gavaldon asked if that it does go through, how will it have an impact on the
traffic from the north coming south and visa versa.
Mr. Bracke replied that it will significantly improve the traffic.
Member Gavaldon asked about when the construction would happen for the roundabout.
Mr. Bracke replied that at this time the expect to go out to bid on December 28'n
Construction would begin on March 1 s . Substantial completion and completely open to
traffic on July 1s'. Fully completed by the end of July.
Chairperson Colton asked for an update on what has been done to improve the
intersection of Vine and Lemay. What is the current thinking on the level of service now
and into the future?
Mr. Bracke replied that he has switched it over to a split phase, which would allow the
northbound traffic to go first, then south and soon. It actually improved the level of
service. But they have had a lot of complaints about the lines being longer so they have
put it back to the original phasing, but reduced the cycle length to a 60 second cycle.
Currently the intersection is operating at a level of service B.
Member Craig asked about Mulberry to Link Lane because she thinks that people will use
that route to try and circumvent the roundabout.
Mr. Bracke replied it is a local connection and will have curb and gutter. There are no
improvements on Link Lane at all, but there will be connections to Magnolia. Mr. Bracke
did not think people would avoid the roundabout.
Member Craig asked Mr. Goldberg about getting a pedestrian link all the way to the street
with this filing.
Mr. Goldberg stated that the ultimate users have not been identified for the two pad sites
and he felt that without that they could not put in the connection at this time because the

city Planning Department and city staff on plans for the roundabout. Their plans have
been modified. They have funded their portion of the roundabout which substantially
funds the cost of the roundabout. They have checked with Transportation Planning and it
is their understanding that they still have them as a high priority to put in the pedestrian
sidewalk links from the neighborhoods to the north further south to their project. That
funding is scheduled for 2001. The new Transit route that is to go by their project is now
up and running as well. The final plans for Lot 2 are in substantial compliance with the
approved Preliminary P.U.D. and meet all the conditions of the preliminary approval. The
only changes that have been made are for some architectural detailing that have to do
with some of the pedestrian breezeways between the buildings. They have also made
some changes to accommodate the roundabout.
The technical data and the infrastructure approval was done with Lot 1 and they are
under construction with Lot 1 now and are in the process of building the infrastructure like
121h street, Magnolia, the water and sanitation for the entire project. He stated that the
architecture is one of the most important features of the project. It is the same
architecture style they brought forward with Wal-Mart. It borrows from the turn of the
century industrial style that exists in downtown. They think it is important that the
architectural link that they are bringing with their project will give the Mulberry Lemay
Crossings the lasting architecture that the city of Fort Collins will be proud of as well.

Member Craig asked about the pedestrian connection that goes through the center of the
project and then stops at the area that is not developed. Did Planner Shepard feel that it
would be important that it go onto the street instead of just coming to the green area.
Planner Shepard replied that they have the anticipation and expectation that when the
two pad sites come in there will be a continuous walkway. There will be some breaks in
crosswalks or parking lot drives. We also expect there to be crosswalks. There is a note
on the plans that says that the crosswalks will be put in where necessary.
Member Craig asked if the Preliminary Plan showed the walkway all the way to the street.
Planner Shepard replied possibly.
Member Craig stated that was an important connection and it bothers her that it is now
stopping where it is instead of bringing it out to the street.

Bob Smith, Director of Stormwater Utility responded that adopting the Master Plan does
not mean that fees will increase 6 to 8 percent for 10 years. What determines the rates is
how fast you build the improvements. The way it has been done in the past is through
the budget process where you submit a 5-year plan and here is what needs to be done in
the next 5 years. You look at the revenues and growth and that process sets the fees.
Chairperson Colton felt it should be the same process as the Capital Improvements and
go to the voters. Since it does not go to a vote there needs to be the same amount of
public discussion and awareness of it.
Member Gavaldon commented that he felt that all parties that benefit needed to pay a fair
contribution. The School District, the County and the University should be partners with
the city in this because they do benefit in their own way.
The motion was approved 6-1 with Member Torgerson voting in the negative.

Mulberry-Lemay Crossings, Filing Two, Final
P.U.D., #36-96E
Project Description: Request for the southern portion of the Mulberry
Lemay Crossings community/regional shopping
center. Filing Two consists of 15.54 acres which
includes a 2.01 acre stormwater detention pond.
The retail center will be on 13.26 acres and
include 128,050 square feet of gross leasable
area. Buildings D and E combing to form a large
retail establishment consisting of 83,550 s.f.
Recommendation: Approval
Hearing Testimony, Written Comments and Other Evidence:
Ted Shepard, Chief Planner gave the staff presentation. The three conditions of
Preliminary approval have been met and staff is recommending approval of the Final
P.U.D.
Mark Goldberg, Developer of the Mulberry Lemay Crossings gave the applicant's
presentation. He stated that it has always been their commitment to build a quality
Regional Shopping Center with an affordable housing component. In keeping with their
commitment, they have paid the $200,000 for the Mulberry pedestrian bridge, although
that was not a requirement of their Preliminary P.U.D. They have been working with the
