continuing up the tower elements on the north, west and east elevations. As
presently depicted, these areas are EIFS (Dryvit) that are framed by brick. The
result is that these areas become de -facto `°sign panels." Staff requests that these
areas be "bricked -in" for better continuity of the overall architectural scheme.
14. As we have discussed, the "Red Standing Seam Metal Roof' for the KFC tower
should be toned down to a more "brownish -red" or "colonial" red. This is more
compatible with the overall scheme of the entire shopping center. The tower
color found on the existing store in Rocky Mountain Village in Loveland would
be acceptable. The color of the "Accent Trim Band and Parapet Cap" should
modified accordingly as well.
15. Staff is very concerned about the "Purple Accent Band Below Parapet Cap." This
purple accent is not found anywhere else in the center, is excessive, not on the
Loveland store, and must be eliminated.
16. Be sure there is sufficient space within the trash enclosure to.accommodate
containers for recyclable materials.
17. Staff prefers that the title of the site plan be "Mulberry-Lemay Crossings, Phase
Three, K.F.C./Taco Bell, Portion of Lot 6, Filing Two." This is so we can track
all projects associated with this center alphabetically and by filing -in our
computerized development tracking system.
18. Please correct the zoning in the Site Statistics to C, Commercial.
19. A building envelope needs to be illustrated on the Site Plan. Also please call out
the distances to the north, east and south property lines.
20. Please label the property line on the Site Plan. .
This concludes Staff comments at this time. Please note that you have 90 days to respond
to these comments. Extensions are available. Otherwise, the Planning Director has the
authority to remove the project from the development review system.

for this proposal. If the southern portion of the shopping center (south of
Magnolia), approved as Filing Two, does not precede this proposal, then
KFC/Taco Bell must provide a temporary design to handle storm flows that would
have been captured by the 48-inch diameter storm sewer.
7.. Please see the attached redline plans from East Larimer County Water District
("ELCO").
8. Excel Energy (natural gas) requires that trees not be planted within four feet of a
gas line.
9. It is very important to coordinate the location of the above -ground, pad -mounted
electrical transformer with Light and Power and the Landscape Plan. The
transformer should be located in a location that is not visible from either public
street. The transformer must be within ten feet of hard surface for emergency
change -out and yet, at the same time, be screened from view. This will require a
screen wall or dense vegetation. Generally, a good location is near the trash
enclosure and back side of the building. Please locate the transformer on both the
Site Plan and Landscape Plan. The contact at Light and Power is Doug Martine,

10. The estimated Street Oversizing Fee is $75,603.29. This is based on I.T.E. Code
832 "Fast Food Restaurant with Drive -Through Window." The Larimer County
Road Fee may also be applicable. These fees are due at the time of building
permit issuance. Please verify these fees with Matt Baker, 221-6605.
11. The major east -west pedestrian spine that bisects the large parking lot to the east
must be continued to Lemay. This sidewalk is shown on the approved
Preliminary P.U.D. between "Retail G and H." This walk.would logically split
your south property line and the north property line of "Retail H." This walk is
shown to be eight feet wide. The approved Preliminary also indicates that this
walk is to be tree -lined. If this walk is divided between two properties, it must
constructed with Phase Three. An easement for the southern off -site portion
would be needed. KFC/Taco Bell would then be repaid by the adjoining
developer.
12. Staff is concerned about the drive -through lane configuration. As designed, there
is a 39-foot wide curb cut along the access drive which is not desirable for
pedestrians. Also, there is stacking area for only three cars behind the menu
board which appears to be insufficient. Staff recommends that the drive -through
lane be taken off the internal east -west drive further west of the curb cut. The
area of the trash enclosure could be moved. This would solve the problem of the
excessively wide curb cut and afford more stacking. An approximate version of
this layout was illustrated on a pre -submittal plan dated May 15, 2001.

Dear Mr. Pridemore:
Staff has reviewed the request for a KFC/Taco Bell drive-thru restaurant also known as
Mulberry Lemay Crossings, Phase Three. The following comments are offered:
1. The City's Traffic Operation Engineer has rejected the Transportation Impact
Study. It is outdated and does not factor in a drive -through restaurant. A full
updated study is needed to process Phase Three of this shopping center. The new
study should obtain new traffic counts after all the roadways are open and Wal-
Mart is up and running. There also remains a concernwith the Vine/Lemay
intersection. The project does have some "vested" trips and Traffic Operations
will need to evaluate the differences between the original T.I.S. and the new T.I.S.
as well as the actual trips generated by an open Wal-Mart. For further
information, please contact Eric Bracke, 221-6630.
2. Please refer to the attached comment sheet and redlines from Engineering. A
critical concern is timing. If this project (Phase Three of the Mulberry - Lemay
Crossing Shopping Center) develops before Filing Two, then this project will
have to show what interim improvements will be made to the overall utilities,
including street improvements for fire access.
3. The parking lot layout for the balance of the center east of the site is not accurate.
Please show the layout as approved for Filing Two.
4. On the Site Plan, be sure all sidewalks are dimensioned.
5. The legal description on the Site Plan does not match the approved plat for Filing
One, nor the soon -to -be -recorded plat for Filing Two. Where does the reference
to Lot 6 come from?
6. Please refer to the attached comment sheet and redline plans and report from
Stormwater. Please note that the timing of construction has serious implications
