Subject to compliance with the stated condition, Mulberry & Lemay Crossings PUD was
granted final approval for 144 multi -family residential units (and associated clubhouse /
recreational area uses).
The applicant is pursuing the completion of utility plans'and a development agreement
as required by City Code prior to the recording of applicable Mulberry & Lemay
Crossing PUD, Buffalo Run Apartments, Final plans and documents. No further
Planning and Zoning Board or City Council approvals are required.

To Whom It May Concern:
Please be advised that the above referenced property, located within the City of Fort
Collins, is currently zoned C, Commercial District.
On October 2, 1997, the Planning and Zoning Board of the City of Fort Collins approved
the Mulberry and Lemay Crossings PUD, Buffalo Run Apartments, Final pursuant to
Section 29-526 of the City Code (The Land Development Guidance System) with the
following condition:
"Due to the potential or actual limitations on downstream stormwater runoff
capacity in existing County development, and the potential impact that such
limitations create for the on -site detention pond for this development, and
because verification of the actual runoff capacity of the downstream outfall
system is pending, the Utility Plans for this development have not been
completed. Therefore, this Final PUD approval is conditioned upon the
requirement that Final Utility Plans must be prepared by the developer and
approved in writing by the Stormwater Utility and the Final Plat and PUD must be
properly recorded in accordance with City requirements before layout and
density are vested for this development and/or construction site work can
commence. "
