RE: Buffalo Run Apartments, Final P.U.D. - Condition of Approval
Staff is recommending the following condition of approval be attached to the Buffalo Run
Apartments, Final P.U.D.:
Due to the potential or actual limitations on downstream stormwater runoff capacity in existing
County development, and the potential impact that such limitations create for the on -site
detention pond for this development, and because verification of the actual runoff capacity of the
downstream outfall system is pending, the Utility Plans for this development have not been
completed. Therefore, this Final P.U.D. approval is conditioned upon the requirement that Final
Utility Plans must be prepared by the developer and approved in writing by theStormwater Utility
and the Final Plat and P.U.D. must be properly recorded in accordance with City requirements
before layout and density are vested for this development and/or construction site work can
commence.

B. Final architectural elevations have been provided for the clubhouse which meet
the intent and character of the Preliminary P.U.D.
4. Findings of Fact:
In reviewing the request for Final P.U.D., Staff makes the following findings of fact:
A. The Final P.U.D. is in substantial conformance with the Preliminary.
B. At Preliminary, the project earned a total of 105 points on the Residential Uses
Point Chart justifying the density of 17.04 dwelling units per acre at this location.
C. The project continues to comply with the All Development Criteria of the L.D.G.S.
D. The P.U.D. is feasible from a traffic operations standpoint and complies with
transportation policies.
RECOMMENDATION:
Staff recommends approval of Buffalo Run Apartments, Final P.U.D., #36-96C.

COMMENTS:
1. Background:
The surrounding zoning and land uses are as follows:
N: I; Vacant (Lincoln East Convenience Store Preliminary P.U.D.)
S: C; Vacant (Mulberry - Lemay Crossing O.D.P.)
E: I (County); Existing Mix of Retail and Industrial
W: CCR; Link `N Greens Public Golf Course
The property was annexed in 1995 as part of a larger parcel. It is contained within the
Mulberry - Lemay Crossing O.D.P. which was approved on March 24, 1997. The
property has historically been used for agricultural purposes. This is the first
development proposal on this site.
2. Land Use:
A. Overall Development Plan
As mentioned, the site is designated as Parcel A of the Mulberry - Lemay Crossing
O.D.P. According to the O.D.P., Parcel A is "Multi -Family Residential' with an
estimated density of 19.7 dwelling units per acre. The request for Final P.U.D.,
therefore, is in compliance with the approved Overall Development Plan.
B. Final P.U.D.
At Preliminary, the P.U.D. was evaluated by the Residential Uses Point Chart of the
L.D.G.S. The P.U.D. has a density of 17.04 dwelling units per acre. The P.U.D.
satisfies the two absolute criteria in that (1.) The project earns a minimum of 100 total
points and that (2.) the project earns a minimum of 40 points from the "base" variable
criteria. A total of 105 points were earned. The project, therefore, is considered
appropriate at this location.
3. Changes Since Preliminaryy:
A. Landscaping
In addition to the street trees between walk and curb, a significant amount of
ornamental trees have been added along Lemay and Lincoln. Shrub beds are specified
for each building entry.

PROJECT DESCRIPTION:
This is a request for Final P.U.D. for 144 multi -family dwelling units on 8.47 acres
located at the southeast corner of Lemay Avenue and Lincoln Avenue. The units are
divided among eight buildings. The request includes a clubhouse, pool, and
recreational facilities. The parcel is zoned C, Commercial. The request is a P.U.D.
reviewed by the Land Development Guidance System.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
The Final P.U.D. is in substantial compliance with the Preliminary and continues to
satisfy the All Development Criteria of the L.D.G.S. At Preliminary, the project earned a
total score of 105 points on the Residential Uses Point Chart of the L.D.G.S. There
were no conditions of approval at preliminary.
