Fischbach, City Manager Greg Byrne, CPES Director Glen Schlueter, Stormwater Utility File Letter to Mr. and Mrs. DeMaranville June 12, 1998 Page 2 As Vine Drive (if the annexation is approved) would be within the City's limits, then the maintenance of the road and right-of-way would become the responsibility of the City of Fort Collins. Given that portions of Vine Drive would remain in the County, it is highly likely that both jurisdictions will share in the maintenance of the road. Annexation, itself, will not result in improvements to Vine Drive. Any improvements to the road would be related directly to a proposed development and/or be funded by the City or County as a capital improvements project. Will annexation of the school trigger involuntary annexation of any surrounding properties? The proposed annexations do not create an enclave which the City would seek involuntary annexation within a three year period. In order for an enclave to be created, the area must be completely surrounded on all sides by existing development located within the City limits. The right-of-way along Vine Drive does not create an enclave situation as there is no development within the City limits located adjacent to Vine Drive. If a property owner is located adjacent to City limits, and he/she wishes to develop on his/her property, the County would direct that individual to the City to pursue voluntary annexation. The change of use of a property would classify as development. According to the requirements outlined in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City would be obligated to accept and process such an application. The proposed zoning would be based upon the City Structure Plan, and only those uses allowed in the proposed zone district would be permitted. The proposed Lincoln Junior High School and neighborhood is an area wherein the low -intensity nature of existing development has been recognized in the City Structure Plan, and does not appear to be a direction in which the City of Fort Collins is considering forced annexations. Any annexations would be strictly voluntary, brought forth by the property owners. Will the ball fields at Lincoln Junior High School be lit? The Poudre School District has indicated that there is no proposal currently to light the ball fields, but if a proposal were brought forth, the District would be supportive of it. and Current Planning City of Fort Collins Mr. and Mrs. L. DeMaranville 1529 West Vine Drive Fort Collins, Colorado 80521 Dear Mr. and Mrs. DeMaranville: 12 June 1998 This letter is to respond to several issues and questions you have raised at the neighborhood meeting as well as with the City Manager on May 6, 1998. Thank you for taking the time to bring these issues to our attention. Was there an incorrect notification of affected property owners? As part of the requirements to submit an annexation petition, the applicant is required to submit a list of the names and addresses of affected property owners that are located within 500 feet of the proposed site. The labels submitted by the applicant were erroneous, and thus, resulted in the failure to notify some affected property owners.. As you are aware, this is one of the primary reasons which staff recommended to the City Council to delay action on the proposed annexations and to remand the matter back to the Planning and Zoning Board for further consideration. The area of notification was expanded to beyond 1000 feet, and included all the affected property owners located adjacent to the proposed annexations. What jurisdiction would be contacted in the case of an emergency? If there is an emergency on your property and you dial 911, the County Sheriff's Department will be contacted to respond to the call. If there is an emergency on the school's property, and they dial 911, the City Police will respond. It may be highly likely that both jurisdictions would respond, depending on their proximity to the emergency. If you wish to report an emergency dealing with the school's property, when you call 911, please indicate that the call is for the school, not the location of the origin of the phone call (your property).
