HomeMy WebLinkAboutREDWOOD APARTMENTS - PDP - 15-99A - CORRESPONDENCE - LUC REQUIREMENTS (5)Commm. _y Planning and Environmental, vices Current Planning Citv of Fort Collins Drew Thomas VF Ripley 1113 Stony Hill Fort Collins, CO 80525 Dear Mr. Thomas, =OW December 22, 1999 During the meeting with you, Phil Brown, myself, Mark McCallum, and Kathleen Reavis, there were several issues that I said I would follow up on regarding the "Dry Creek" apartments site. 1. Phil wanted to know what the back yard setback would be for the buildings abutting the ditch if there was a trail along the ditch, and also what the setback would be if there wasn't a trail along the ditch. The section of the code which regulates that setback is 3.5.2(D)(3), which specifies that "rear yard setbacks in residential areas shall be a minimum of fifteen feet from the rear property line." In this case the rear property line would be considered the edge of the access easement. The Parks Planning Department would want a 30 to 50 foot wide easement along the ditch, if the trail goes there. I'm not sure how wide the current easement is for the ditch company road, but as far as I understand, there is currently an accesses easement for it. 2. Phil also wanted to know how we find out on which side of the ditch the trial will be required to go. We have some internal staff discussions that need to happen between the Transportation Planning Department and the Parks Planning Department to determine which side of the ditch the trail will ultimately be located. 3. Finally, I said I would provide for you the new code language dealing with private streets and private drives. Please see the attached sheets.
