right of way. The nearest public right of way is Swallow Road, and existing landscaping
will completely screen the proposed Cricket compound. Consequently, no additional
landscaping is proposed.
5. A new meter for power will be required at this site. Cricket has already been in contact
with Light and Power.

Attached you will find revised drawings, along with the City's red lined drawings, for the
proposed Cricket Communications wireless telecommunication equipment located at 1300
Swallow Road (Rocky Mountain High School). All of the format changes marked in the red lines
have been made and the format requests in the letter you sent to me, dated June 8, 2001 have also
been made.
The remainder of this document will address some of the design changes requested in your letter:
2. Modification for Chain -link fence: Cricket would like to request a modification of City
Standards for the type and height of fencing we are requesting. As you stated in your
letter, Section 2.8 (H)(1-3) of the City of Fort Collins Land Use Code allows for a
modification of City standards if the modification would neither be detrimental to the
public good nor impair the intent and purposes of the Land Use Code, and if at least one
of three criteria is met. Cricket feels the proposed fencing design meets the first criteria
established by the first standard:
• "The plan as submitted will advance or protect the public interests and purposes
of the standard for which the modification is requested equally well or better than
would a plan which complies with the standard for which a modification is
request."
• The proposed Cricket design calls for an 8' tall, chain link fence surrounding the
ground mounted base transmitting equipment (BTS). The purpose of the fence is
not to screen the equipment, because the equipment will not be visible from a
public right of way. The equipment needs to fenced for safety purposes. The
chain link fence will also match the fencing surrounding the Nextel equipment,
which is adjacent and contiguous to the proposed Cricket compound. In addition,
there is a large amount of existing chain link fence around the tennis courts and
the football stadium. The proposed Cricket fencing matches the material and
appearance of the existing fencing. In summary, the proposed design will
advance or protect the public interests and purposes of the standard for which the
modification is requested equally well or better than would a plan which
complies with the standard for which a modification is request.
