The proposed equipment would be mounted on an existing telecommunications tower that was constructed and used for various telecommunications prior to the adoption of the City's Wireless Telecommunications Ordinance. In addition, the existing tower is used for a wide range of telecommunication functions (hard wire, microwave) and not solely used for wireless telecommunications. Therefore, Staff finds that the existing tower is a structure that is used for some other purpose and is eligible for wireless telecommunications equipment. D. The proposed equipment meets the applicable standards of Section 3.8.13 {C} of the Land Use Code. RECOMMENDATION: Staff finds that the request to mount an array of nine antennas, in three groups of three, for wireless telecommunications on to an existing structure, at the northeast corner of Magnolia Street and South Mason Street, is in compliance with the City's Land Use Code. Staff, therefore, recommends approval of 124 West Magnolia Street, Wireless Telecommunications Equipment, Administrative Review, #11-97A. 124 West Magnolia Street (Existing Tower), Wireless Telecommunications Equipment Administrative Review, #11-97A May 27, 1997 Page 2 "Wireless telecommunication services facility" shall mean any freestanding facility, building, pole, tower or structure used to provide only wireless telecommunication services, and which consists of, without limitation, antennae, equipment and storage and other accessory structures used to provide wireless telecommunication services. Based on these definitions, the existing tower, which provides a wide range of communication functions that go well beyond wireless telecommunications, is not considered a "wireless telecommunication services facility." Therefore, the request is considered "equipment' that is mounted on a "structure that is used for some other purpose." B. Zoning The site is zoned D, Downtown. Wireless telecommunication equipment is permitted in this district subject to administrative review. Section 3.8.13 of the Land Use Code permits wireless telecommunications equipment to be attached to or mounted on any existing building or structure located in any zoning district in the City. Wireless telecommunications equipment shall not, however, be permitted to be attached to or mounted on any residential building containing four or fewer dwelling units. C. Standards The request meets the following applicable standards for wireless telecommunication equipment as found in the Land Use Code under Section 3.8.13: 3.8.13 {C} (3) - Height: The proposed antennas do not exceed the height of the structure. 3.8.13 {C} (3) - Color: The color of the antennas will match the existing structure. All other standards are non -applicable. 2. FINDINGS OF FACT: In review and consideration of this request, Staff makes the following findings of fact: A. The proposed antennas are defined as wireless telecommunications equipment. B. Wireless telecommunications equipment is permitted in the D, Downtown, Zone District. ITEM NO. Arapahoe Road, Suite 315 Englewood, CO 80112 OWNER: U.S. West Corporation 124 West Magnoial Street Fort Collins, CO 80521 PROJECT DESCRIPTION: Request to mount wireless telecommunications equipment on an existing tower located north of an existing U.S. West office building at the northeast corner of West Magnolia Street and South Mason Street. Initial installation would be an array of six antennas, in two groups of three. Request includes capability of adding one group of three antennas for a total array of nine. COMMENTS: LAND USE: A. Definitions The Land Use Code defines "wireless telecommunications services equipment' as any equipment used to provide wireless telecommunication services, but which is not affixed to or contained within a wireless telecommunication services facility (monopole or tower), but is instead affixed to mounted on an existing building or structure (or substantially similar replacement structure) that is used for some other purpose. Provided, however, such equipment shall also mean a ground mounted base station used as an accessory structure that is connected to an antenna mounted on or affixed to an existing building.
