Mr. Kitze:
In addition to my 3 page Land Use Code interpretation dated April 12, 2002 in response to your request
about Contextual Building height, my records indicate that I have responded to your requests seven other
times during the past six months.
I'm sorry for the misunderstanding about the rezoning issue, but I responded two months ago in a phone
message. Based on my telephone log, that message was left on Tuesday, July 23rd.
As I said in my message, the City was in error when the area was zoned MMN during the 1997 citywide
rezoning process. According to conversations I had with Ken Waido, Chief Planner with the City's
Advance Planning Department, Horsetooth Road was supposed to be the dividing line, with the higher
density designation of MMN to the north and the lower density LMN area to the south. One note of
correction to your comment is that the existence of zero lot line, single-family residences in your
neighborhood had nothing to do with Ken's comments.
When the City makes an error in the zoning of a parcel, there is no formal application process or set
deadline for the rezoning to go forward. Now that it has been brought to our attention, City staff will pursue
the rezoning, with the necessary legal description and public notice, and take it through the formal review
process (Planning and Zoning Board recommendation and City Council action). If possible, we try to
"bundle" rezonings so that this application would be coupled with any other map corrections we're aware
of.
As the City -staff has stated in the past, rezoning of your neighborhood will not impact the pending Bella
Vista Project Development Plan on the northeast corner of Horsetooth and Stanford.
