HomeMy WebLinkAboutBELLA VISTA - PDP - 45-01A - CORRESPONDENCE - CITY STAFF (4)1) Land uses at Bellavista are proposed to include the following: a) Multifamily residential condominiums (81 dwelling units) b) Mixed -use dwellings per code c) "Type 1" nonresidential uses per the MMN Zoning District to help meet the consumer needs of surrounding residential areas (per Principle MMN-3) comprising: i) Artisan and/or photography studios/galleries ii) Short-term lodging (B&B or similar) with six beds maximum iii) Convenience retail without fuel sales; per the L.U.C., each such individual use shall be less than 5,000 SQ. FT.; and sell everyday goods and services which may include, without limitation, ready -to -eat food products, groceries, over-the-counter drugs and sundries. d) Accessory Uses including: i) Home occupations when the mutual home (condo) owner/business owner is a resident, and the business area is included in the ownership of that individual's condominium. ii) In convenience retail, food service uses beyond the "ready to eat" food products allowed by right in "convenience retail" if the food preparation area is limited to 300 SQ. FT. or less (similar to food preparation areas typically found as accessory uses in other convenience stores). PERIOD. no further explanation is needed. All the extra language just adds unnecessary wording that could come back to bite us. It needs to go. ii) under accessory uses may still be a way to get a restaurant use of some sort. The definition of "convenience retail store" doesn't contain any language about "food service uses beyond the ready -to -eat food products". We can't amend a definition through a PDP. It's either a convenience retail store or it's not. Which means that they can probably have a small food preparation area, but it has to be within a convenience retail store. And I don't think tables and chairs would be allowed, because then I believe we'd have 2 principal uses - a convenience retail store and a restaurant. So they need to understand that food preparation would need to be clearly an accessory function of the c-store. Hopefully they already do.
