Subject: Connell -Rogers Annexation
Troy, Mary H. with TST asked me to respond to your letter dated June 4,
1999 and email dated June 11. We are proceeding with preparation of the
hydrological studies and CLOMR preparation with all available speed. It
appears to me that we are proceeding under Option #2 detailed in your
letter less by conscious selection and more by default. We have retained a
consultant to complete the engineering for the CLOMR. Until such time as
the consultant can better describe what is possible for the site the
annexation is on hold.
I am not comfortable with proceeding under the "T" zoning concept. My
experience with such matters leads me to conclude that we need to negotiate
an arrangement which leads directly to the requested "HC" zoning with some
kind of a mutually acceptable fall out clause if "we can't get there from
here". We have not made any recent contacts with Larimer County regarding
this site either. As the consultant's work progresses and we have a work
product to share we will be back in touch with you.
I think that I have responded to the information requests in your
correspondence. What I am unclear on is whether the City needs some
additional formal directive from the property Owners? Please advise. My
