(12/29/10] The modifications were approved, allowing for a plan with 5 dwelling units. The
final plan submittal doesn't reflect this. Need a clarification of what's really being proposed.
If it's going to be for only 4 dwelling units, why are there 2 driveways shown on the site plan
for Lot 3? Also, some of the driveways shown on the site plan would indicate that the
garages they lead to would not comply with the required 5' setback. This would indicate that
0' buildings are proposed, as per the modification that was approved. If buildings are
proposed as per the modification, the footprints and elevations are needed as per the
original comment.
[12/1/10] If the modifications are approved, then the building footprints need to be shown on
the site plan. If the modifications are approved, then the architectural building elevations
must be shown on a 24 x 36 size sheet and included with the final plans.
Be sure and return all of your redlined plans when you re -submit.

within the outside boundary is 39,826 square feet; however, adding up the square footages
of Lots 1 - 4 and Tract A gives a total of 39,827 square feet. Which is correct?

City Light & Power, presumably meaning that they will be sharing trenches. Any pedestal

[12/30/101 The Final Landscape Plan still shows Littleleaf Lindens as street trees along Frey
Street. Further discussion with Traffic Operations is needed.
[11/2/10] Traffic feels the Little Leaf Linden trees as shown on the landscape plan will be a
sight distance issue for residents backing out of the driveways to see traffic on Frey St. and
for Frey Street motorists seeing the backing vehicles. The LTL can have a very low canopy
as it matures causing sight distance issues with vehicles and with traffic signage. Please
revise to a street tree that lower canopy meets sight distance criteria as stated in the
LCUASS.

PROJECT DESCRIPTION:
This is a request to subdivide and replat a platted parcel of land into four (4) lots to
contain four (4) separate single-family dwellings and one (1) carriage house dwelling.
Each dwelling unit will have either a detached or attached garage. The existing lots,
platted as Frey Street Cottages, are located at the southeast corner of LaPorte Avenue
and Frey Street. The parcel is currently vacant and is in the NCL - Neighborhood
Conservation, Low Density District.
The Final Site Plan shows a total of 4 dwelling units, presumably not accounting for the
approved carriage house on the rear of Lot 3. Since the carriage house was granted a
modification of standard it must be accounted for on the Final Site Plan. If the
developer/property owner wants to completely eliminate the carriage house then the Final
Plan would not be in conformance with the approved PDP by virtue of decreasing the
number of dwelling units by more than 1 %, which would constitute a Major Amendment to
the approved PDP. This would require going back to an Administrative Public Hearing per
Section 2.2.10(B)(1) of the Land Use Code. There is not a definable time frame in which the
carriage house must be built and, therefore, it would be beneficial to the developer/property
owner to keep it on the development plans and possibly do a Major Amendment in the future
if the intent were to eliminate the carriage house completely.

[12/30/101 There is a 5' Utility Easement shown along the north line of Lot 3 on the Site Plan
and the Subdivision Plat. The developer/property owner is proposing a carriage
house/garage building at a zero setback on that lot line. The building cannot be located over
the utility easement and this was discussed during the PDP development review process.
Whatever utility is to be in the easement to provide service(s) to buildings on Lots 3 & 4 can
be located in the 5' Utility Easement along the north line of Lot 2. The 10' Pedestrian Access
Easement on Tract A and Lot 4 can become a Pedestrian Access and Utility Easement to
help get utilities to the lots.

set forth in Sections 4.7(D)(2), 4.7(E)(4), 4.7(E)(5) and 4.7(F)(2)1 &2 of the Land Use Code.
The aforementioned Modifications of Standards must be indicated on the Site Plan.
