A. Consistent with the City's Comprehensive Plan:
The requested POL zoning is consistent with the recently adopted 1-25 Subarea plan.
This plan is adopted as an element of the City's Comprehensive Plan. The plan
designates this parcel as POL.
FINDINGS OF FACT/CONCLUSIONS
After reviewing the Resource Recovery Farm Rezoning, File #4-04, staff makes the
following findings of fact and conclusions:
A. The subject property for the Resource Recovery Farm Rezoning is designated on
the 1-25 Subarea Plan, an element of the City's Comprehensive Plan as Public
Open Lands, to be preserved as public open space.
B. The proposed rezoning will promote the public welfare and will be consistent with
the visions, goals, principles and policies of City Plan and the elements thereof,
specifically the 1-25 Subarea Plan.
RECOMMENDATION
Staff recommends that the Planning and Zoning Board recommend that City Council
approve the Resource Recovery Farm Rezoning #4-04, Amendment to the Zoning Map
from E-Employment District to the POL, Public Open Lands District.

placed into the POL District.
The purpose of the POL District according to the City's Land Use Code is as follows:
The Public Open Lands District is for large publicly owned parks and open lands
which have a community -wide emphasis or other characteristics which warrant
inclusion under this separate designation rather than inclusion in an adjoining
neighborhood or other district designation.
FINDINGS and ANALYSIS
1. Background:
The surrounding zoning and land uses are as follows:
N: C Undeveloped
S: POL City -owned open space
E: C & FA1(County); Commercial/Retail/Agriculture
W: RC City -owned open space
The property was annexed into the city as part of the 325 acre Sludge Farm Annexation
in June of 1988. Approximately 144 acres of the area was previously purchased by the
Natural Resources Department to be preserved as open space. The remaining 25
acres +/- located immediately southwest of the Prospect Road/1-25 interchange is zoned
C-Commercial and is currently for sale by the City.
The Utilities Department operated a sludge application process on the property until
transferring that operation to other sites in northern Larimer County. The Utilities
Department recently sold the 156 acre parcel to the Natural Resources Department.
2. Quasi -Judicial Rezoning:
The property included within the rezoning request is less than 640 acres, and is
therefore, considered a Quasi -Judicial Rezoning. In order for the Planning and Zoning
Board to recommend approval of a rezoning to the City Council, the following criteria
shall be met:

PROJECT DESCRIPTION:
This is a request to rezone a tract of land located south of East Prospect Road and west
of Interstate Highway 25. The parcel is approximately 156 acres in size and is currently
zoned in the E-Employment District. The proposed rezoning would rezone the land from
the E District to the POL, Public Open Lands District. The parcel is designated to be
preserved as open lands according to the recently adopted 1-25 Subarea Plan.
RECOMMENDATION
Approval.
EXECUTIVE SUMMARY:
The rezoning request is consistent with the recently adopted 1-25 Subarea Plan. The
subarea plan includes the following policy:
Policy 1-25-NOL-1.2: The City will explore the possibility of converting the
Resource Recovery Farm property, located at Prospect Road and 1-25, for use
as open space.
In addition, within the "Implementation Actions" chapter of the plan, the following
"Implementation Strategies" are listed: ,
Resource Recover Farm Property — Pursue the acquisition of this site as City -
owned open space.
Zoning Districts — Utilize the Zoning Plan Map as a basis for guidance on both
the zoning of properties as they annex into the city, and for the rezoning of
properties already inside the city limits.
