Michael Phelan Cedar Creek Associates 916 Wilshire Avenue Fort Collins, Colorado 80521 Dear Mr. Phelan: Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered Species Act of 1973 (ESA), as amended (16 U.S.C. 1531 et seq.), the Service reviewed the Preble's meadow jumping mouse, Zapus hudsonius preblei (Preble's), habitat assessment report submitted with your letter of November 25, 2003. This report regards the proposed site plan review for the In -Situ Inc.'s Development Site in Latimer County, Colorado. Based on the information provided, and given your compliance with the Preble's survey guidelines, the Service finds the report acceptable and agrees that a population of Preble's is not likely to be present within the subject area. Thus, the Service concludes that the proposed project on this site should not have direct adverse affects to Preble's. Should Preble's populations exist downstream from the site, actions on the site that result in significant modifications of Preble's habitat downstream (for example, through alteration of existing flow regimes, or sedimentation) may be subject to provisions of the ESA. Please note that this clearance is valid for one year from the date of this letter. Should additional information on listed or proposed species become available, this determination may be reconsidered under the ESA. If the proposed project has not commenced within one year, please contact the Colorado Field Office to request a project extension. The service accepts the report and agrees that Preble's are not likely to be present within the subject are and that the project should not adversely effect the population. If agreeable I would like to investigate receiving a block clearance similar to what Metro Denver and Colorado Springs has done (http://mountain-prairie.fws.gov/preble/i)mim%20manacie.htm#block%20clearance). I would like to explore block clearance for both the Poudre River and Spring Creek. This would help to speed up the development process for these areas. With help from Stormwater and Natural Areas we may be able to accomplish this in house with minimal outside costs. Doug CC: Bob Zakely
