We will continue to explore pedestrian/bicycle connectivity options with the City, however, the UPRR and PUC have made it clear that our original at grade railroad crossing is not a viable option. Finally, the Traffic Study has been revised per Staff Comments regarding level of service and a letter to Eric Bracke outlining the revisions is included in the re - submittal of the Spring Creek Farms O.D.P. The O.D.P. drawing has been revised to more clearly depict the limits of each parcel as per comments. All City of Fort Collins redlines have been attached to this re -submittal. CK:eom In addition to a written response to each item of the Staff Review Comments issued on September 7th, the re -submission of this project includes copies of the First Neighborhood Meeting Notes. Both the City and the applicant generated a set of notes. The notes created by the applicant specially address issued raised by the neighbors at the meeting. The Comments issued on September 2011, ask the applicant to consider the location of the proposed intersections on Timberline Road. Staff made preliminary comments regarding intersection spacing, and those recommendations have been refined based on storage requirements. For further information, please refer to the Traffic Impact letter addressed to Eric Bracke that accompanies this re -submission. The signalized intersection on Timberline Road will be located at least 1/3 mile (1,980') north of the Drake Road and Timberline Road intersection as per comments. The proposed, limited movement (right in, right out), local street intersection closest to the intersection of Drake Road and Timberline Road will be located 750' north of the centerline of the Drake Road and timberline Road intersection. Nuszer Kopatz has been asked to located the third intersection on Timberline Road in coordination with the developable property across Timberline Road to the east of the site. The design charette planned to address this issue has not been held, and at present it appears the charette will not take place until November. Therefore, the location of the second, limited movement (3/4 movement), local street intersection will be 1,330' from the centerline of the Drake Road and Timberline Road intersection, as shown on the O.D.P., until after the charette has been held. With regard to the request for and justification of alternative compliance to L.U.C. Sections 3.6.3(C) and 3.6.3(D) that relate directly to the issues discussed in the paragraph above; at this date the applicant has received neither information nor guidance to suggest that either is necessary. The proposed Timberline intersections remain as show on the original O.D.P. submission unless otherwise noted. The applicant recognizes that LUC Section 3.6.3(E) requires multi -modal access. The comment regarding a non -vehicular crossing of the Union Pacific Railroad tracks has been noted. A pedestrian and bicycle connection across the Union Pacific Railroad tracks requires the approval of the Union Pacific Railroad Company. Sue Grabler, the appropriate railroad company representative, has been contacted to determine if a crossing is possible. It is our understanding that it is not UPRR's policy to open new public or private at grade crossings. Furthermore, any public crossings fall under the authority of the Colorado Public Utility Commission. This letter is accompanied by and itemized response to each set of Comments as well. Revisions to each of the applications are being re -submitted within 45 days of the original submission to the City. In the Comments issued on September 7th it states that staff supports the justification and request for a Structure Plan Amendment. The proposed zoning is consistent with the Fort Collins Comprehensive Plan, and therefore the new zoning will be consistent with the Structure Plan, which is an element of the Comprehensive Plan. The first set of Comments also addresses the size and configuration of the "E-Employment" component of the project. The applicant has taken those comments into consideration and applied them based on the location of the proposed signalized intersection on Timberline Road, as dictated by the Comments issued on September 20ul. Those comments request that the traffic signal be located no less than 1/3 of a mile from the intersection of Drake Road and Timberline Road.
