The City of Fort Collins is the applicant for three annexations east of 1-25 and
south of East Mulberry Street (State Highway 14). These three annexations are
referred to as:
1. Interchange Lands First Annexation
2. Interchange Lands Second Annexation
3. Waterdale Annexation
These three annexations are triggered by the voluntary request to annex the
State Highway 14 — East Frontage Road Annexation which begins a sequence of
contiguity. The four are proceeding as a package through the annexation and
zoning process.
Consistent with the Intergovernmental Agreement (IGA) between the City of Fort
Collins and Larimer County, a binding Annexation Agreement was required as a
condition of approval when development plans for these properties were
approved by Larimer County. The provisions of the Annexation Agreements state
that the City Clerk may proceed with annexation as the attomey-in-fact at the
time the properties become contiguous to the City and thus eligible for
annexation.
The requested zoning for the two Interchange Lands parcels is C, Commercial.
The requested zoning for Waterdale is L-M-N, Low Density Mixed -Use
Neighborhood.
Please note that Boxelder Creek separates the two Interchange Land parcels
from Waterdale.
The City Clerk is the petitioner for these three annexations under a power of
attorney contained in the Annexation Agreements.
As of this writing, there are ongoing discussions with the Waterdale property
owner. The anticipated result of these discussions is that in exchange for a
commitment for future access to the southwest, and in exchange for an updated
power of attorney on the Annexation Agreement, the City, as applicant, would not
proceed with annexation of Waterdale at this time. The City would reserve the
right to annex at a future date but only after a specific period of time has passed.
These discussions have not concluded but Staff hopes to update the Planning
and Zoning Board at its July 15, 2005 worksession.
