under (we are at about 10.5 acres). Would the *Mixed -Use, Institutional and
Commercial Buildings* section 3.5.3 apply to our project?

Jennifer,
It was very nice talking with you recently.
The news you probably do not want to hear is that you apparently were looking at a version of the Land
Use Code (LUC) that is Supplement 11 or earlier. On page 21, Article 5 - Terms and Definitions of
Supplement 12 of the LUC (adopted by City Council in July, 2002), the definition of a Large Retail
Establishment states that it "shall mean a retail establishment, or any combination of retail establishments
in a single building or in separate but abutting buildings, or a movie theater or an indoor recreational use,
occupying more than twenty-five thousand (25,000) gross square feet of floor area". As you can see, the
reference to excepting supermarkets has been eliminated fron this definition. Therefore, as a minimum,
the King Soopers Supermarket and Retail Spaces A & B attached to King Soopers are subject to
the requirements set forth in Section 3.5.4 - Large Retail Establishments in the LUC.
In answer to your question about Section 3.5.3 - Mixed -Use, Institutional and Commercial Buildings and its
applicability to this project ..... yes, it does apply. The definition of Commercial Development in Article 5 of
the LUC states that commercial development "shall mean any land development activity except
development intended solely for residential, industrial and/or light industrial use". The Shops at Rigden
Farm certainly meet this definition.
Also, the Shops at Rigden Farm project is subject to all applicable sections of Article 3 - General
Development Standards and the Land Use and Development Standards set forth in Division 4.19 -
Neighborhood Commercial District (NC) in the LUC.
Has Wyatt & Associates subscribed to the supplement document service for the semi-annual LUC
changes? If so, you should be receiving Supplement 12 soon, if you have not already.

After all was said per our recent conversation on the Land Use Code and
classifying The Shops at Rigden Farm, I decided to look in the *terms and
definitions* section of the Land Use Code. Their definition of Large Retail
Establishment is described as,**shall mean a retail establishment, or any
combination of retail establishments in a single building, or a movie

thousand gross squire feet of floor area, except that no supermarket shall
be deemed to be a large retail establishment.* Under Article 5, Page 21.
Well, I suppose I answered my own question and the concern with parapet
height is no longer an issue. The Shops at Rigden Farm is comprised of one
65,000 s.f. supermarket and several retail buildings which are each all
under 25,000 square feet. The *large retail establishment* requirements
sound like they apply to something along the lines of shopping malls and
probably not our development.
I suppose my question now is what part of the Land Use Code building
