Re: Redtail Request for Variance #9 — Variance to place a retaining wall in the utility
easement along the west side of College Avenue.

Dear Susan:
The following is a request for variance from Section 12.3.1 Utilities in the "Larimer County
Urban Area Street Standards, October 1, 2002". This variance request is to allow the placement
of a retaining wall within a utility easement. A utility coordination meeting was held on February
23, 2005 with the local utility providers. During that meeting it was decided that the retaining
walls are acceptable within the utility easement. Conditions of acceptance included adding
sleeves under the retaining wall for each of the utility providers. A joint trench will be utilized for
phone, cable and electric. Gas will be placed in its own trench.
The retaining walls are necessary with the current site layout to maintaining acceptable street,
sidewalk and parking area slopes. The retaining wall also helps to minimizes the amount of steps
required at the entry of the multi -family buildings located along Fossil Boulevard.
A Sleeving Plan has been included into the Redtail construction plans with the conditions from
the utility coordination meeting being met.
This variance from the above standard will not be detrimental to the public health. All utilities
are available to the development using typical utility installation guidelines. Issues that may
compromise public safety and welfare have been addressed to the greatest extent possible.
