Reference is made to a recent site visit by Mr. Terry McKee of this office concerning the
above -mentioned project located in the NE V4 of section 12, Township 6 North, Range 69 West,
Larimer County, Colorado. During Mr. McKee's visit it was determined that the open water and
wetlands which are to be impacted by this project developed incidental to construction activities and
as a result of drainage ditches constructed on uplands. In that regard, these water filled depressions
and wetlands are not waters of the U.S.
The )Fossil Creek Community Park project has been reviewed in accordance with Section
404 of the Clean Water Act under which the U.S. Army Corps of Engineers regulates the discharge
of dredged and fill material, and any excavation activity associated with a dredge and fill project, in
waters of the United States which may include streams, open water lakes, ponds or wetlands. Based
on the plans presented, this project will not require a Department of the Army (DA) permit.
Although a DA Permit will not be required for the project, this does not eliminate the
requirement that other applicable federal, state, tribal, and local permits are obtained if needed.
