EASEMENT DEDICATION
KNOW ALL MEN BY THESE PRESENTS; That SW PRODUCTION COMPANY, a Colorado
limited partnership ("SW"), and FRONT RANGE LUBRICATION, INC., a Colorado
corporation ("FRL"), having the interests described below in Tract 1 and Tract 2, K-Mart Plaza,
City of Fort Collins, County of Larimer, State of Colorado, do hereby dedicate and convey to and
for public use, forever, the easements described below, provided, however that acceptance by the
City of Fort Collins (the "City") of this dedication of easements does not impose upon the City a
duty to maintain the easements so dedicated.
1. A utility easement situate in Tracts 1 and 2, K-Mart Plaza, City of Fort Collins, County of
Larimer, State of Colorado, which begins at a point on the South line of said Tract 1 which bears
S 89049'00" W 6.00 feet from the Southeast corner of said Tract 1 and run thence N 00018'00"
W 160.00 feet; thence S 89°40'00" W 40.00 feet; thence S 0098'00" E 16.50 feet; thence
S 89049'00" W 16.50 feet; thence S 00018'00" E 10.00 feet; thence N 89°49'00" E 16.50 feet;
thence S 00°18'00" E 133.50 feet to a point on the South line of said Tract 1; thence
N 89049'00" E 40.00 feet to the point of beginning (the "Utility Easement Area").
2. A drainage easement situate in Tracts 1 and 2, K-Mart Plaza, City of Fort Collins, County
of Larimer, State of Colorado, which begins at a point which bears N 00°18'00" W 160.00 feet
and again S 89°49'00" W 29.00 feet from the Southeast comer of said Tract 1 and run thence
N 00018'00" W 3.50 feet; thence N 7299'00" W 70.00 feet; thence S 17°41'00" W 10.00 feet;
thence S 72019'00" E 50.39 feet; thence N 89°49'00" E 21.74 feet to the point of beginning (the
"Drainage Easement Area").
SW has an ownership interest in both the Utility Easement Area and the Drainage Easement Area
(which interest is subject to those matters_ reflected on a title policy that SW will deliver to the
City). FRL has a leasehold interest in the Utility Easement Area.
