Union Place Subdivision and the City of Fort Collins are parties to an Affordable Housing Plan
(Plan) on file with the City Clerk which stipulates that the developer, Merten Inc., must record a
Restrictive Covenant with the Larimer County Clerk and Recorder to ensure certain units remain
"affordable". Per the Plan, no building permits may be issued until the City receives a copy of
the Restrictive Covenant with proof that it has been recorded.
As of the date of this Memorandum, the Restrictive Covenant has.not been recorded;
therefore, please do not issue any building permits for Union Place Subdivision until further
notice.
