KNOW ALL MEN BY THESE PRESENTS that Pine Cone - IRET, Inc., a Colorado corporation, whose
address is c/o 1200 1-74h Street, # 1950, Denver, CO 80202 ("Grantoel hereby grants and conveys unto the City
Of Fort Collins, a Colorado municipal corporation, whose address is 300 LaPorte Avenue, Fort Collins, Colorado
80521 ("Grantee") an easement for the installation, maintenance, repair and replacement of a sanitary sewer line
in, over, under and across a tract of land owned by Grantor situate in the Northwest 1/4 of Section 29, Township
7 North, Range 69 West ofthe & P.M., which said casement is more particularly describe) as considering the West
line of the Northwest 114 of said Section 29 as bearing N 00'04'32" West from an aluminum cap in a monument
box at the West 1 /4 corner of said Section 29 to an aluminum cap in a monument box at the Northwest corner of
said Section 29 and with all bearings contained herein and relative thereto is contained within boundary lines that
commence at the West 1 /4 corner of said Section 29 and run thence North 89045'52" East 1,306.04 feet to a point
on the North right of way of Pinecone Circle, said point being the Point of Beginning, thence N 44007'30" West
75.22 feet to a point on the South line of the First Asse nbly of God "Church triangular parcel" described at
Reception No. 94067101; thence along said South line, North 85'1418' East, 25.87 feet; thence, departing said
South line, South 44607'30" East 5 1.5 1 feet to a point on the West line of Lot 35, Dakota Ridge P.U.D., Third
Filing; thence along said West line, South 30'57'21" East 10.97 feet to a point on the North Right of Way line
Pineconc Circle, said point also being on a non -tangent curve concave to the Southeast, having a central angle of
01035'09", a radius of 644.00 feet and the chord of which bears South 56'48'28" West 17.82 feet; thence along
the are of said curve 17.92 feet to the Point of Beginning.
This Deed of Easement is made by Grantor on condition that it shall not be effective until Mellon Mortgage
Company, the holder of a deed of trust encumbering the property consents to the granting of this easement, Such
consent shall be obtained before this easement is recorded and recorded with this easement.
IN WITNESS WHEREOF, Grantor has caused this Deed of Easement to be executed by Pine Cone -

SUBJECT: First Assembly of God Church Development - Sanitary Sewer Easement
In accordance with the telephone conversation between Lucia A. Liley and Mike Ludwig on
November 12, 1997, this deed of easement has been executed by the owner of the property crossed
by the easement. We have retained the original easement and are submitting a copy. We have
contacted Mellon Mortgage Company in order to obtain their consent to the easement. Their consent
will require approval from HUD. Everyone contacted agrees that the easement will be approved, but
it has to work through the process. As soon as it is approved, we will obtain the signature of Mellon
Mortgage Company on the original and submit that to the City.
