HomeMy WebLinkAboutPVH MEDICAL OFFICE BUILDING & PARKING STRUCTURE - PDP - 14-07 - CORRESPONDENCE - CITIZEN COMMUNICATION (3)SEP-20-2007 August 9, 2007 Poudre Valley Health Systems (PVHS) is willing to enter Into an agreement to provide for the reimbursement by PVHS of one-half (1/2) of the actual costs for snow removal from the sidewalks and/or parking areas of the Affected Property as mitigation for those portions of such sidewalks and parking surfaces which may be negatively impaled by the shadow cast by the parking structure. PVHS will also grant access for parking in the parking structure for any "lost" parking spaces due to snow accumulation within the impacted shadow area. Such agreements shall each Include the following elements: the property owners shall contract for, pay and assume all liabilities for snow removal on the Affected Properties; the property owner shall bill PVHS on a monthly basis one-half (1/2) of the costs of such snow removal and PVHS shall reimburse within thirty (30) days of receipt of Invoice; the property owner shall competitively bid the snow removal work (i.e. getting at least three quotes); and the agreement would remain in effect until the Affected Properties were to redevelop In any manner which would require City development review approval. Lemay, the property immediately north and adjacent to proposed PVH parking garage and a Party in Interest On September 20, 20071 entered testimony at the P and Z meeting and would Ike to clarify some statements made that night by PVH. I dispute the statement that i was offered a contract to share snow removel costs from our parking lot and roof as was stated at the meeting. Although I did receive a contract for the parking lot, there was no reference to the roof whatsoever. Since our roof is flat this is a major point, In my estimation, so I did not sign IL Also there has been no offer from PVH to share any Iabift resulting from Injuries due to ice not metling and people slipping and failing because of the problem caused by the parking garage shadow. I have also been shown two different shadow studies, one shadow covering 75% of my property and one covering 21396. When Steve Ellsworth from PVH was asked why there were two radically dfferent studies and how do I know which one is correct, he said he didn't know but would find out That was about two weeks ago and 198H have not heard from him.
