The purpose of this letter is to grant to the City of Fort Collins a license to use the Martinez Park
property that Wonderland Hill Development Company ("WHDC") is purchasing from Trillium
Corporation as described in the attached Exhibit "A" as public parking for Martinez Park. This
license is good until WHDC begins construction of this property which we estimate to be in
October, 1997. The City shall take all necessary steps to ensure that the City's property and
liability insurance policies and/or programs cover the uses permitted under this grant of license.
The parties recognize that there are other issues regarding storm drainage and temporary
construction easements that need to be resolved and will work in good faith through the City's
Development process, utilizing a Development Agreement to address these issues.
