STAFF RECOMMENDATION:
Staff recommends approval of the Burlington Northern at McClelland Drive Annexation and H-B,
Highway Business Zoning.
COMMENTS:
1. Background:
The Burlington Northern at McClelland Drive Annexation is approximately .5 acres of railroad
right-of-way, located south of Drake Road, between McClelland Drive and Redwing Road. It is
located within the Fort Collins Urban Growth Area (UGA). According to policies and
agreements between the City of Fort Collins and Larimer County, contained in the
INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS .URBAN
GROWTH AREA, the City will agree to consider for annexation property in the UGA when the
property is eligible for annexation according to State law.
Enclave areas become eligible for annexation when they have been completely surrounded by
properties that are within the City limits for at least three years. The area to be annexed has been
an enclave for at least three years and is therefore, eligible for annexation. The area became
completely surrounded through the following annexations:
N:. Ghent Annexation - June 26, 1966; Meadowlark First Annexation - December 27,
1964
S: Meadowlark First and Second Annexations - December 27, 1964, April 25, 1965
E: Bartells First Annexation - February 27, 1966; Ghent Annexation - June 26, 1966
W: Meadowlark First Annexation - December 27, 1964
This area became eligible for involuntary annexation into the City on June 26, 1969. It was left
out of the area annexations and is a small piece of railroad right-of-way owned by Burlington
Northern Railroad. This area has not shown on previous City maps as being outside the
unincorporated area; however, recent work on the City's GIS discovered this enclave.
Annexation of this enclave is for housekeeping purposes.
2. Zonin
The proposed zoning for this annexation is the H-B, Highway Business District. The H-B District
is for automobile -oriented businesses and is found along College Avenue, from Prospect to
Harmony road. The western boundary of this zone has generally been the Burlington Northern
Railroad tracks. The proposed zoning is consistent with the policies of the City's Comprehensive
Plan and is compatible with the surrounding zoning, which is predominantly Highway Business.
FINDINGS OF FACTICONCLUSION:
1. The annexation of this area is consistent with the policies and agreements between Larimer
County and the City of Fort Collins, as contained in the INTERGOVERNMENTAL
AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA.
2. The area meets all criteria included in State law to qualify for annexation by the City of Fort
Collins.

TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a
Resolution initiating annexation proceedings for the Burlington Northern/McClelland Drive
Annexation, said Annexation being more particularly described in said Resolution, a copy of which
precedes this Notice.
That, on July 1, 1997, at the hour of 6:00 p.m., or as soon thereafter as the matter may come
on for hearing in the Council Chambers in the City Hall, 300 LaPorte Avenue, Fort Collins,
Colorado, the Fort Collins City Council will consider the passage of an annexation ordinance
concerning the subject property.
The City of Fort Collins will make reasonable accommodations for access to City services,
programs and activities and will make special communication arrangements for persons with

Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said
Notice establishes the date, time and place when the Council will consider the passage of an
annexation ordinance pertaining to the above described property. The City Clerk is directed to
publish a copy of this Resolution and said Notice as provided in C.R.S. Section 31-12-108(2).

OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND INITIATING
ANNEXATION PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS
THE BURLINGTON NORTHERN/McCLELLAND DRIVE ANNEXATION
WHEREAS, the property hereinafter described has, for a period of not less than three (3)
years prior to this date, been completely contained within the boundaries of the City of Fort Collins;
and
WHEREAS, the Council desires to initiate annexation proceedings in accordance with State
law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That, the Council of the City of Fort Collins intends to annex the following
described property, to be known as the Burlington Northern/McClelland Drive Annexation, situate
in the County of Larimer, State of Colorado, to wit:
A Tract of Land Situate in the Northeast Quarter of Section 26, Township 7 North,
Range 69 West of the 6th P.M., County of Larimer, State of Colorado, Considering

Annexation, Thence; SO1°18'00"W - 303.32 Feet on and along the Westerly Line of

The property became eligible for annexation as an enclave on June 26, 1969.
The annexation is made up of one parcel and is owned by Burlington Northern Railroad.
Planning and Zoning Board Recommendation
The Planning and Zoning Board conducted a public hearing on the annexation and zoning request
at its regular monthly meeting on March 24, 1997. The Board recommended that the Council
approve this annexation by a vote of 5-0.

EXECUTIVE SUMMARY:
The property being considered for annexation has, for a period of not less than three (3) years, been
completely surrounded by property contained within the boundaries of the City of Fort Collins. The
property being considered for annexation is approximately 0.5 acres in size and is located south of
Drake Road between McClelland Drive and Redwing Road. The property consists entirely of
railroad right-of-way. The proposed zoning for this annexation is C - Commercial.
The proposed Resolution states that it is the City's intent to annex this enclave property and directs
that the published notice required by State law be given of the Council meeting to consider the
needed annexation ordinance. The time of First Reading of the annexation and zoning ordinances
is scheduled for July 1, 1997. Not less than thirty days prior published notice is required by State
law.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area (UGA). According to policies
and agreements between the City of Fort Collins and Larimer County contained in the
Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to
consider annexation of property in the UGA when the property is eligible for annexation according
to state law. The property became completely surrounded by the City of Fort Collins through the
following annexations:
