Prentice Avenue, Suite 815 Greenwood Village, CO 80111 Gentlemen: As one of the owners of property in the Harmony Technology Park O.D.P, Imago Enterprises, Inc. has submitted to the City an application for minor modifications to the February 5, 2000 approved plan. These changes affect Imago property only, and they do not affect any of your rights as other parties to the O.D.P and our June, 2001 Agreement. These changes are 1. Adding to the plan three (3) residential properties along Cambridge and owned by Imago. Totaling three (3) acres, these properties have been recently annexed by the City. The addition of these properties increases the O.D.P. from 267.19 acres to 270.19 acres. 2. Consolidating Tracts "G", "H" and "I" owned by Imago into a single Tract "G", thereby serving the site design for this 11.8 acre area as a mix of primary and secondary uses. 3. Increasing the secondary uses in the new Tract "G" from 7.5 acres to 8.25 acres, with the additional 0.75 acres coming from the three (3) acres O.D.P. increase (25% x 3 acres). These changes affect Imago properties only. Once these changes have been approved by the Planning and Zoning Board, I will contact you to arrange for your signatures on the amended plan and for getting to you an approved plan set. Section 2.3.2 (H) (5) — Transportation Connections to Adjoining Properties This criterion requires an O.D.P. to provide for the location of transportation connections to adjoining properties to ensure connectivity into and through the O.D.P. from neighboring properties for vehicles, pedestrians and bikes as per Sections 3.6.3 (F) and 3.2.2(C)(6). There are no changes to the existing transportation connections to adjoining properties. F. 2.3.2 (H)(6) — Natural Features This criterion requires an O.D.P. to show the general location and size of all natural areas, habitats and features within its boundaries and shall indicate the rough estimate of the buffer zone as per Section 3.4.1(E). There are no changes to the natural habitats and features within the boundaries of the amended O.D.P. G. Section 2.3.2 (H) (7) — Drainage Basin Master Plan This criterion requires an O.D.P. to be consistent with the appropriate Drainage Basin Master Plan. There are no changes to the existing or proposed stormwater drainage system. H. Section 2.3.2 (H) (8) — Housing Density and Mix of Uses This criterion requires that any standards relating to housing density and mix of uses will be applied over the entire O.D.P. and not on each individual P.D.P. There are no changes to the housing density. The mix of secondary uses continues to comply with the standard that no more than 25% of the O.D.P. be designated as secondary uses. 3. Findings of Fact/Conclusion: In evaluating the request for Harmony Technology Park Second Amended O.D.P., Staff makes the following findings of fact: E. Compliance with Applicable Standards of the Land Use Code: Section 2.3.2 (H) of the Land Use Code identifies eight criteria for reviewing O.D.P.'s. A. Section 2.3.2(H)(1) — Permitted Uses and District Standards This criterion requires the O.D.P. to be consistent with the permitted uses and applicable zone district standards and any applicable general development standards. The O.D.P. continues to indicate potential land uses that comply with the permitted uses within the Harmony Corridor zone district. B. Section 2.3.2 (H) (2) This criterion requires that the O.D.P. be consistent with the required density range of residential land uses if located in the L-M-N or M-M-N zone district. There are no parcels zoned L-M-N or M-M-N within the O.D.P. C. Section 2.3.2 (H) (3) This criterion requires that the O.D.P. conform to the contiguity requirements of the Compact Urban Growth Standards as per Section 3.7.2. The O.D.P., including the new three acres, is located within the city limits. Celestica, Harmony House and Brookfield are platted, constructed and served by public improvements. Rock Creek Drive is constructed and also serves abutting developments (Observatory Village and Fossil Ridge High School). D. Section 2.3.2 (H) (4) This criterion requires the O.D.P. to conform to the Master Street Plan and street pattern and connectivity standards as required by Section 3.6.1 and 3.6.3 (A) through (F). In addition, the O.D.P. shall also conform to the Transportation Level of Service Requirements as contained in Section 3.6.4. The proposed amendment leaves the Master Street Plan and internal street pattern and connectivity network in place. Adding Three New Houses on One Acre Lots The fundamental change is that three new gross acres are being added to the O.D.P. by Imago Enterprises, one of the five owners of the entire O.D.P. These three new acres are the three existing single family homes that front on Cambridge Avenue and sit on one acre each. Imago is adding these three new acres to old Parcel J (8.9 acres) and re -lettering to new Parcel H (11.9 acres). These three properties were recently annexed as an enclave. B. Consolidating Parcels G, H and I into Parcel G Under the existing O.D.P., Parcels G, H and I comprise 11.8 acres. The amendment would consolidate these into one Parcel G also comprising 11.8 acres. C. Increasing Secondary Uses on New Parcel G By adding three new acres to the O.D.P., the amount of allowable secondary uses can be increased proportionally as well. Secondary uses are limited to 25% of the total. Since three new gross acres are added, an increase .75 acre of secondary uses are now allowed (3.00 acres x .25 = .75 acre). This .75 acre of new secondary uses is being added to the new Parcel G. D. Re -lettering of the Parcels With the consolidation of Parcels G, H and I into a new single Parcel G, the balance of the parcels are re -lettered. There are no changes to remainder of the O.D.P. that is owned by the other four entities. Description of the Proposed Changes to the O.D.P.: There are four components to the proposed amendment. The proposed addition includes the existing home sites addressed as 4800, 4804 and 4808 Cambridge Avenue. The addition of three acres will increase the total acreage of the O.D.P. from 267.19 acres to 270.19 acres. The amendment also includes consolidating Tracts G, H and I into a single Tract G, and slightly increasing the amount of land area for secondary uses from 7.5 to 8.25. The site is generally located south of Harmony Road and east of Cambridge Avenue. The zoning is H-C, Harmony Corridor. EXECUTIVE SUMMARY: A.
