NOTICE TO ALL PERSONS INTERESTED: PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a Resolution initiating annexation proceedings for the Miller -Fox Annexation and Zoning, said Annexation being more particularly described in said Resolution, a copy of which precedes this Notice. That, on October 21, at the hour of 6:00 p.m., or as soon thereafter as the matter may come on for hearing in the County Chambers in the City Hall, 300 LaPorte Avenue, Fort Collins, Colorado, the Fort Collins City Council will consider the passage of an annexation ordinance concerning the subject property. The City of Fort Collins will make reasonable accommodations for access to City services, programs and activities and will make special communication arrangements for persons with disabilities. Mayor ATTEST: City Clerk RESOLUTION 97-_ OF THE COUNCIL OF THE CITY OF FORT COLLINS STATING THE INTENT OF THE CITY OF FORT COLLINS TO ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS THE MILLER -FOX ANNEXATION WHEREAS, the property hereinafter described has, for a period of not less than three (3) years prior to this date, been completely contained within the boundaries of the City of Fort Collins; and WHEREAS, the Council desires to initiate annexation proceedings in accordance with State law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That, the Council of the City of Fort Collins intends to annex the following described property, to be known as the Miller -Fox Annexation, situate in the County of Larimer, State of Colorado, to wit: A TRACT OF LAND SITUATE IN THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 7 NORTH, RANGE 68 WEST OF THE 6TH P.M., COUNTY OF LARIMER, STATE OF COLORADO, CONSIDERING THE EAST LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 32 AS BEARING S 000 05' 42" E WITH ALL BEARINGS CONTAINED HEREIN RELATIVE THERETO IS CONTAINED WITHIN THE BOUNDARY LINES WHICH BEGIN AT THE EAST QUARTER CORNER OF SAID SECTION 32 AND RUN THENCE N 89 ° 3732" w 30 FEET TO A POINT OF INTERSECTION WITH THE WESTERLY RIGHT-OF- WAY LINE OF COUNTY ROAD #9, THE TRUE POINT OF BEGINNING FOR THIS DESCRIPTION, CONTINUING; N 890 37' 32" W 995.69 FEET ON AND ALONG THE BOUNDING LINE OF SPRING CREEK FARMS FOURTH ANNEXATION THENCE; S 00 ° 05' 42" W 175.00 FEET ON AND ALONG THE BOUNDING LINE OF SAID SPRING CREEK FARMS FOURTH ANNEXATION, THENCE; S 89 ° 37' 32" E 995.69 FEET ON AND ALONG THE BOUNDING LINE OF SAID SPRING CREEK FARMS FOURTH ANNEXATION, THENCE; N 000 05' 42" W 175.00 FEET ON AND ALONG SAID ANNEXATION LINE, ALSO BEING THE WESTERLY RIGHT-OF-WAY OF COUNTY ROAD #9 TO THE TRUE POINT OF LD-refflejelle CONTAINING 4.00 ACRES MORE OR LESS. Section 2. That the Council hereby initiates annexation proceedings for the above - described property. Section 3. That the Notice attached hereto be adopted as part of this Resolution. Said Notice establishes the date, time and place when the Council will consider the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to September 16, 1997 2 The annexation is made up of one parcel. The owners of record are: Deann Miller and Donnette G. Fox 2335 Wapiti Road Fort Collins, Colorado 80525 The Planning and Zoning Board will conduct a public hearing on the annexation and zoning request at its October 2, 1997, meeting. Their recommendation will be included in the Agenda Item Summary for the City Council hearing. n September 16, 1997 Leanne A. Harter Resolution 97- Stating the Intent of the City of Fort Collins to Annex Certain Property and Initiating Annexation Proceedings for Such Property to Be Known as the Miller -Fox Annexation and Zoning. Staff recommends adoption of the Resolution. The property being considered for annexation has, for a period of not less than three (3) years, been completely surrounded by property contained within the boundaries of the City of Fort Collins. The property being considered for annexation is approximately 4.00 acres in size, located on the west side of South County Road 9, between Horsetooth Road and Harmony Road. The proposed zoning for this annexation is HC-Harmony Corridor District. The proposed Resolution states that it is the City's intent to annex this enclave property and directs that the published notice required by State law be given of the Council's hearing to consider the needed annexation ordinance. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on October 21, 1997. Not less than thirty days prior published notice is required by State law. BACKGROUND: The property is located within the Fort Collins Urban Growth Area (UGA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. The property became completely surrounded by the City of Fort Collins through the following annexations: N: Spring Creek Farms 4th Annexation - April 19, 1994 E: Spring Creek Farms 4th Annexation - April 19, 1994 S: Spring Creek Farms 4th Annexation - April 19, 1994 W: Spring Creek Farms 4th Annexation - April 19, 1994 The property became eligible for annexation as an enclave on April 19, 1997.
