This property is. currently zoned FA-1, Farming, in Larimer County. The proposed zoning for this
annexation is HC-Harmony Corridor Zone District The HC Zone District is intended to implement
the design concepts and land use vision of the Harmony Corridor Plan and to create an attractive
and complete mixed -use area with a major employment base. Much of the adjacent area is zone HC-
Harmony Corridor. The proposed zoning is consistent with the City Structure Plan and the principles
and policies in City Plan, and is patibl th st' uses surrounding zoning.

approve the Miller -Fox Annexation with a zoning of HC-Harmony Corridor Zone District.
STAFF RECOMMENDATION:
Staff recommends approval of the Miller -Fox Annexation with a zoning of HC-Harmony Corridor
Zone District, which is consistent with the adopted City Structure Plan.

The Miller -Fox Annexation consists of approximately 4.00 acres, located generally on the west side
of County Road 9, between Horsetooth Road and Harmony Road. It is located within the Fort
Collins Urban Growth Area (UGA). According to policies and agreements between the City of Fort
Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins
Urban Growth Area, the City will agree to consider annexation of property in the UGA when the
property is eligible for annexatio ccordin state Th intent Qf the policy is that properties

standard, not a rural standar
Enclave areas, become eligible annex n wh they hav een completely surrounded by
properties that have been within the City limits for at least three (3) years. The area to be annexed
has been an enclave for at least three (3) years and therefore, is eligible for annexation.. The property
became completely surrounded by the City of Fort Collins through the following annexations:

The property became eligible r inv on as an a ave on April 19, 1997. The site
includes one residence, and an g ci igns must , nform to the City's Sign Code at
the conclusion of a five-year amortization period. This annexation will not increase the total number
of off -premise signs that currently exist in the City of Fort Collins.
There are several issues related to enclave annexation areas that warrant the City considering their
annexation.
• First is the desirability to consolidate the provision of public safety services. While
fire service is pr . ' by u my ' oth enclave areas and within
City limits, p ce se are t to the City.
• The second i e o oid co n among the property owners,
surrounding property owners, and the City or County entities. Again, this is related
to the provision of public safety services as it is not uncommon for those individuals
who are part of an enclave to not realize they are actually part of the County, not the
City.
The third issue pertains to the likelihood of development occurring under County
regulations rather than those of the City. The Intergovernmental Agreement between
the City of Fort Collins and Larimer County only applies to those land use decisions
requiring an action by the Board of County Commissioners. Therefore, development
may take place through the issuance of building permits for permitted uses.
On Monday, September 8, 1997, staff met with Mr. Doug Dietz of 2336 Wapiti Road, Fort Collins,
Colorado 80525, a brother to the owner of record. Mr. Dietz raised a concern as to whether, once

EXECUTIVE SUMMARY:
A. Second Reading of Ordinance No. 157, 1997, Annexing Property Known as the Miller -Fox
Annexation and Zoning.
B. Second Reading of Ordinance No. 158, 1997, Amending the Zoning District Map of the City
of Fort Collins and Classifying for Zoning Purposes the Property Included in the Miller -Fox
Annexation.
On October 21, 1997, Council unanimously adopted Resolution 97-138 Setting Forth Findings of
Fact and Determinations Regarding the Miller -Fox Enclave Annexation and Zoning.
On October 21, 1997, Council also unanimously adopted Ordinance No. 157, 1997 and Ordinance
No. 158, 1997, which annex and zone an enclave area approximately 4.00 acres in size, generally
located on the west side of South County Road 9, between Horsetooth Road and Harmony Road. The
property is an existing single-family residence with accessory structures that allow for horses on the
property. The recommended zoning for this annexation is HC-Harmony Corridor District, which
is consistent with what is identified on the City Structure Plan.
