Director is preparing an administrative interpretation that addresses
whether or how ODPs approved under the code provisions in effect at
the time the project was submitted may be amended. This information
may affect the use of this site.
b) You may need to comply with the development standards for non-
residential and mixed -use buildings in the LMN zoning district —
Division 4.4(E)(2). (Please contact me for clarification on this issue.)
c) Please refer to Divisions 3.2 and 3.5, in particular, of the Land Use
Code for standards regarding landscaping, site design and building
standards.
d) Long term care facilities are limited to a maximum number of parking
spaces. That number is .33/bed, and if on -street or shared parking is
not available, then the maximum may be increased by 20% provided
that the parking lot landscaping is increased by 20%.
e) You will need to submit an A.P.O. (a list of affected property owners)
for notification of affected owners with 500' of the property, and a
neighborhood meeting is required prior to submittal.

10. Transfort offered the following comments:
a) Two services may be available for the residents and employees. The
first service is Dial -a -Ride which provides door-to-door transportation
for seniors and disabled individuals. The second service is that City
Plan identifies transit service along Lemay Avenue which would
provide transportation for a limited number of people. It is not known
when this service may begin.

11. The Natural Resources Department offered the following comments:
a) Please design your waste receptacle area with enough space so that
recycling may be accommodated.
b) An application was given at conceptual for fugitive dust control.
c) There is concern about protecting the natural resources along Fossil
Creek. A field visit may be beneficial in order to discuss the minimum
buffer required along Fossil Creek as well as the relationship of the
building to the creek.

12. The Current Planning Department offered the following comments:
a) This proposed use is inconsistent with the approved Overall
Development Plan for Huntington Hills which identifies Parcel A as a
multi -family component. This project does not meet the definition of
multi -family as the definition of dwelling unit in the Land Use Code
states:
"Dwelling unit shall mean one (1) or more rooms and a single
kitchen and at least one (1) bathroom. Designed, occupied or
intended for occupancy as separate quarters for the exclusive use
of a single family for living, cooking and sanitary purposes, located
in a single-family, two-family, or multi -family dwelling or mixed -use
building."
In the strict interpretation of the definition of dwelling unit, an assisted
living facilities (long term care facilities) are a single dwelling unit.
e) You will be required to submit utility plans and a development
agreement (the development agreement will be prepared by the City.)

6. Park Planning offered the following comments:
a) Park fees will be due at time of building permit. This is considered as
one unit for park fees and those fees are based upon square footage.
The fees will be approximately $1,190 for the neighborhood park fee
and $1,308 for the community park fee.

7. The Building Inspections Department offered the following comments:
a) There was a question asked as to whether this was to be designed as
institutional or residential. There is a local amendment to the building
code that would apply to apartments and/or institutional residential.
b) You will be required to meet energy code requirements.
c) You will need approval for the kitchen design by the Health
Department. Please check with the County Health Department for
application requirements.

8. The Poudre Fire Authority offered the following comments:
a) We will require a fire alarm/sprinkler, system.
b) We are opposed to the grasscrete fire lane as they are not plowed in
the winter and require high level of maintenance. We probably would
work with you, however, if this is the avenue you wish to pursue.
c) -We may require an additional fire hydrant along Southridge Greens or
located within the parking lot.

9. The Transportation Planning Department offered the following comments:
a) A Transportation Impact Study (TIS) will be required. The TIS is more
intensive than the traditional traffic study as it examines pedestrian,
these comments.
3. The Stormwater Utility offered the following comments:
a) This site is located within the Fossil Creek Drainage Basin where fees
are $2,274/acre subject to the runoff coefficient reduction.
b) The site is located close to the Fossil Creek drainageway. A stability
and building encroachment study was done in conjunction with
Huntington Hills. These should be reviewed and the building
encroachment and stability limit lines kept in mind as you develop the
area.
c) The standard drainage and erosion control reports will be required.
d) No detention is required on -site. It is recommended that you use a
water quality type facility to slow the drainage to Fossil Creek.
e) The floodplain regulations prohibit critical facilities (of which an
assisted living facility would be classified) from locating in the
floodplain. Please contact the Stormwater Utility to clarify this issue.
f) The three main issues associated with the site include the interface
with the site, bank stability, and discharge to Fossil Creek.

4. Light and Power offered the following comments:
a) There are existing facilities on Southridge Greens and Lemay Avenue.
b) There is power to the site, but you will need to be aware of where the
lines are located.
c) You will need to coordinate the transformer location.
d) For the "Future Expansion Area" shown on the site plan, either show
this as a tract or a second lot.

5. The Engineering Department offered the following comments:
a) The Street Oversizing Fee is $3,324/acre. There may be a possible
repay along Lemay Avenue (talk to Matt Baker at 221-7732).
b) It may be necessary to dedicate additional ROW along Southridge
Greens Blvd.
c) The east access on Southridge Greens may need to be relocated.
The TIS will indicate whether this will need to be done.
d) You will need to submit and Transportation Impact Study (TIS).

LAND USE DATA:
Request for an Assisted Living Facility located at the intersection of Lemay
Avenue and Southridge Greens Boulevard. The site was previously considered
for 160 multi -family units and a neighborhood meeting for that proposed land use
was held. The total acreage of the site equals 10.75 acres, with the assisted
living facility roughly 65,000 square feet in size. The proposed used is to be
designed with vernacular architecture, using low roof lines and.the same theme
as the entrance into Huntington Hills.
COMMENTS:
1. The Zoning Department offered the following comments:
a) The property is located in the LMN-Low Density Mixed Use
Neighborhood zoning district. Long term care facilities are a permitted
use as a Type 2 Review (Planning and Zoning Board Review).

For your information, attached is a copy of the Staff's comments concerning the
assisted living facility (Huntington Hills Parcel A) located at Lemay Avenue and
Southridge Greens Boulevard which was presented before the Conceptual
Review Team on June 2, 1997.
The comments are offered informally by Staff to assist you in preparing the
detailed components of the project application. Modifications and additions to
these comments may be made at the time of formal review of this project.
