That, on March 3, at the hour of 6:00 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 LaPorte Avenue, Fort Collins, Colorado, the Fort Collins City Council will consider the passage of an annexation ordinance concerning the subject property. The City of Fort Collins will make reasonable accommodations for access to City services, programs and activities and will make special communication arrangements for persons with disabilities. Mayor ATTEST: City Clerk RESOLUTION 98-10 OF THE COUNCIL OF THE CITY OF FORT COLLINS STATING THE INTENT OF THE CITY OF FORT COLLINS TO ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS THE FORT COLLINS BUSINESS CENTER 2ND ANNEXATION WHEREAS, the property hereinafter described has, for a period of not less than three (3) years prior to this date, been completely contained within the boundaries of the City of Fort Collins; and WHEREAS, the Council desires to initiate annexation proceedings in accordance with State law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That, the Council of the City of Fort Collins intends to annex the following described property, to be known as the Fort Collins Business Center 2nd Annexation, situate in the County of Larimeritate of Colorado, to wit: V A TRA LAND SITUATE IN THE NORTHWEST QUARTER OF SECTION 7, TOWNSHIP 7 NORTH, RANG 69 ST OF THE 6TH P.M., COUNTY OF LARIMER, STATE OF COLORADO, WHICH CONSID G THE WEST LINE OF THE NORTHWEST QUARTER OF SAID SECTION 7 AS BEARING S02-04'03"W AND WITH ALL BEARINGS CONTAINED HEREIN RELATIVE THERETO IS CONTAINED WITHIN THE BOUNDARY LINES WHICH BEGIN AT A POINT WHICH BEARS S02°04'03 " W 80.00 FEET AND AGAIN S89036'37"E 353.00 FEET FROM THE NW CORNER OF SAID SECTION 7, SAID POINT BEING THE TRUE POINT OF BEGINNING AND ALSO A POINT ON THE NORTHEAST CONSOLIDATED ANNEXATION TO THE CITY OF FORT COLLINS, THENCE ALONG SAID ANNEXATION S02°04'03"W 1250.83 FEET TO A POINT ON THE EAST VINE DRIVE 6TH ANNEXATION TO THE CITY OF FORT COLLINS, THENCE ALONG SAID ANNEXATION N89°36'27"W 17.15 FEET, TO THE POINT OF BEGINNING. CONTAINING 0.4920 ACRES. Section 2. That the Council hereby initiates annexation proceedings for the above - described property. Section 3. That the Notice attached hereto be adopted as part of this Resolution. Said Notice establishes the date, time and place when the Council will consider the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in Section 31-12-108(2), C.R.S. The proposed zoning for the Fort Collins Business Center 2nd Annexation is the LMN-Low Density Mixed Use Neighborhood zone district. Planning and Zoning Board Hearing The Planning and Zoning Board will conduct a public hearing on the annexation and zoning request at its meeting on February 19, 1998. Harter SUBJECT: Resolution 98-10 Stating the Intent of the City of Fort Collins to Annex Certain Property and Initiating Annexation Proceedings for Such Property to Be Known as the Fort Collins Business Center 2nd Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The property being considered for annexation is approximately 0.49 acres in size and is located on the east side of the 1 Oth Street right-of-way. The proposed zoning for this annexation is LMN-Low Density Mixed Use Neighborhood zone district. The property being considered for annexation has, for a period of not less than three (3) years, been completely surrounded by property contained within the boundaries of the City of Fort Collins. The proposed Resolution states that it is the City's intent to annex this enclave property and directs that the published notice required by State law be given of the Council's hearing to consider the needed annexation ordinance. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on March 3, 1998. Not less than thirty days prior published notice is required by State law. BACKGROUND: The property is located within the Fort Collins Urban Growth Area (UGA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. The property became completely surrounded by the City of Fort Collins through the following annexations: N: East Vine Drive 6th Annexation E: Fort Collins Business Center Annexation S: Fort Collins Business Center Annexation W: Northeast Consolidated Annexation The property became eligible for annexation as an enclave on September 2, 1989.
