That, on March 3, at the hour of 6:00 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 LaPorte Avenue, Fort Collins, Colorado, the Fort Collins City Council will consider the passage of an annexation ordinance concerning the subject property. AGENDA ITEM SUMMARY FORT COLLINS CITY COUNCIL ITEM NUMBER: 19 DATE: January 20, 1998 STAFF: Leanne A. Harter SUBJECT: Resolution 98-12 Stating the Intent of the City of Fort Collins to Annex Certain Property and Initiating Annexation Proceedings for Such Property to Be Known as the Lincoln-Lemay Avenue Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The property being considered for annexation is approximately 1.5 acres in size and is located on the west side of North Lemay Avenue, between East Lincoln Avenue and East Mulberry Street. The existing use of the property is a restaurant and retail business. The proposed zoning for this annexation is CCR, Community Commercial-Poudre River. The property being considered for annexation has, for a period of not less than three (3) years, been completely surrounded by property contained within the boundaries of the City of Fort Collins. The proposed Resolution states that it is the City's intent to annex this enclave property and directs that the published notice required by State law be given of the Council's hearing to consider the needed annexation ordinance. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on March 3, 1998. Not less than thirty days prior published notice is required by State law. BACKGROUND: The property is located within the Fort Collins Urban Growth Area (UGA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. The property became completely surrounded by the City of Fort Collins through the following annexations: N: Northeast Consolidated Annexation - June 6, 1974 E: Lemay Avenue 2nd Annexation - April 18, 1989 (Road R.O.W.); Fisher-Lemay Annexation - August 15, 1995 S: Link-N-Greens 3rd Annexation - January 21, 1992 W: Link-N-Greens 3rd Annexation - January 21, 1992
