NOTICE
TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a
Resolution initiating annexation proceedings for the Lemay Avenue 3rd Annexation, said
Annexation being more particularly described in said Resolution, a copy of which precedes this
Notice.
That, on January 5, 1999, at the hour of 6:00 p.m., or as soon thereafter as the matter may
come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins,
Colorado, the Fort Collins City Council will hold a hearing for the purpose of finding and
determining whether the property proposed to be annexed meets the applicable requirements of
Colorado law and is considered eligible for annexation.
The City of Fort Collins will make reasonable accommodations for access to City services,
programs and activities and will make special communication arrangements for persons with
disabilities. Please call 221-6515 for assistance.

RESOLUTION 98-157
OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND
INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY
TO BE KNOWN AS THE LEMAY AVENUE 3RD ANNEXATION
WHEREAS, the property hereinafter described has, for a period of not less than three (3)
years prior to this date, been completely contained within the boundaries of the City of Fort Collins;
and
WHEREAS, the Council desires to initiate annexation proceedings in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That, the Council of the City of Fort Collins intends to annex the following
described property, to be known as the Lemay Avenue 3rd Annexation, situate in the County of
Larimer, State of Colorado, to wit:
A TRACT OF LAND SITUATE IN THE NORTHEAST QUARTER OF SECTION 7, TOWNSHIP 7
NORTH, RANGE 68 WEST OF THE 6TH P.M., COUNTY OF LARIMER, STATE OF COLORADO,
WHICH CONSIDERING THE WEST LINE OF THE NORTHWEST QUARTER OF SAID SECTION
7 AS BEARING S02004'03" WAND WITH ALL BEARINGS CONTAINED HEREIN RELATIVE
THERETO IS CONTAINED WITHIN THE BOUNDARY LINES WHICH BEGIN AT A POINT WHICH
BEARS s02004'03" W 1350.00 FEET AND AGAIN S87055'57" E 30.00 FEET FROM THE
NW CORNER OF SAID SECTION 7, SAID POINT BEING THE TRUE POINT OF BEGINNING AND
ALSO BEING A POINT ON THENORTHEAST CONSOLIDATED ANNEXATION TO THE CITY OF
FORT COLLINS, THENCE ALONG SAID ANNEXATION S02004103" W 300.00 FEET TO A
POINT ON THE EAST LINCOLN THIRD ANNEXATION TO THE CITY OF FORT COLLINS,
THENCE ALONG SAID ANNEXATION s87 ° 55'57"E 288.00 FEET, TO A POINT ON THE FORT
COLLINS BUSINESS CENTER ANNEXATION TO THE CITY OF FORT COLLINS. THENCE
ALONG SAID ANNEXATION N02004'03"E 300.00 FEET, THENCE N87055'57"W 288.00
FEET, TO THE POINT OF BEGINNING.
CONTAINING 1.9835 ACRES.
Section 2. That the Council hereby initiates annexation proceedings for the above -
described property.
Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said
Notice establishes the date, time and place when a hearing will be held regarding the passage of an
annexation ordinance pertaining to the above described property. The City Clerk is directed to
publish a copy of this Resolution and said Notice as provided in Section 31-12-108(2), C.R.S.

SUBJECT:
Resolution 98-157 Stating the Intent of the City of Fort Collins to Annex Certain Property and
Initiating Annexation Proceedings for Such Property to Be Known as the Lemay Avenue 3rd
Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:

The property being considered for annexation is approximately 2.00 acres in size and is located on
the east side of North Lemay Avenue, between East Lincoln Avenue and East Vine Drive. The
property is currently vacant. The proposed zoning for this annexation is LMN - Low Density Mixed
Use Neiahborhood. The property being considered for annexation has, for a period of not less than
three (3) years, been completely surrounded by property contained within the boundaries of the City
of Fort Collins.
The proposed resolution states that it is the City's intent to annex this enclave property and directs
that the published notice required by State law be given of the Council's hearing to consider the
needed annexation ordinance. The hearing will be held at the time of First Reading of the
annexation and zoning ordinances on January 5. 1999. Not less than thirty days prior, published
notice is required by State law.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area (UGA). According to policies
and agreements between the City of Fort Collins and Larimer County contained in the
Intergovernmental Agreemew for the Fort Collins Urban Growth Area. the City will agree to
consider annexation of property in the UGA when the property is eligible for annexation according
to State law. The property became completely- surrounded by the City of Fort Collins through the

E: Fort Collins Business Center .A=exation - September 2. 1986
S: East Lincoln 3rd Annexation - December 6, 1994
W: Northeast Consolidated Annexation - June 6, 1974
The property became eligible for annexation as an enclave on December 6, 1997.
