County Road 13 Fort Collins, CO 80524 Greg Byrne, Director Community Planning and Environmental Services PO Box 580 Fort Collins, CO 80522 RE: Lemay Avenue 3'd Enclave Annexation and Zoning, 934-97 Dear Greg, I had a call into you in mid -June regarding a parcel of land that I own on North Lemay Avenue just south of Buckingham. I had received a letter from the City regarding the City's decision to annex that parcel into the City limits as commercial property. The annexation was scheduled to go before the Planning and Zoning Board within a few weeks. Plans changed when a P & Z Board member thought that this property should be rezoned as Residential, and the annexation was delayed. Leann Harter called to inform me of that delay. My next step was to call you with the following concerns: 1. I bought this county property as Industrial/Commercial and even though it would be annexed into the City, any zoning other than Industrial/Commercial would greatly affect its value. 2. Secondly, I had a contract to sell this piece of property that was hinged on the property remaining suitable for Industrial/Commercial uses. You responded that you would look into this matter right away and get back to me. I have not heard from you other than a phone message stating that you were still looking into it and apologizing for the delay. Now I received this notice. (See attached.) If this is an example of the Planning Department's professionalism and response to a citizen's concern, I will be writing a letter to the Planning and Zoning Board, the City Manager and the City Council. l suggest that this issue be taken off the Board's agenda for Thursday, September 17, 1998 until the City and our respective attorneys have the opportunity to resolve this issue at a lower level. Please note: as I just received this notice last week, I have previous commitments to be out of town on the day of this meeting, September 17, 1998. Sincerely, N.
