That, on April 21, 1998, at the hour of 6:00 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation. At such hearing, any persons may appear and present such evidence as they may desire. The City of Fort Collins will make reasonable accommodations for access to City services, programs and activities and will make special communication arrangements for persons with disabilities. Mayor ATTEST: City Clerk RESOLUTION 98-36 OF THE COUNCIL OF THE CITY OF FORT COLLINS FINDING SUBSTANTIAL COMPLIANCE AND INITIATING ANNEXATION PROCEEDINGS FOR THE SCHAULIN ANNEXATION WHEREAS, a written petition, together with four (4) prints of an annexation map, was heretofore filed with the City Clerk requesting the annexation of certain property to be known as the Schaulin Annexation; and WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings in accordance with law. NUMBER: 23 DATE: March 3, 1998 STAFF: Mike Ludwig SUBJECT: Resolution 98-36 Finding Substantial Compliance and Initiating Annexation Proceedings for the Schaulin Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: CbNS�iT The property being considered for annexation is a total of 4.87 acres in size (including Lincoln Avenue R.O.W.) and is located approximately 1000 feet east of Lemay Avenue; between East Lincoln Avenue and East Magnolia Street. The sole property owner, Fred Schaulin, has requested to be annexed into the City of Fort Collins as a 100% voluntary annexation. The subject property consists of two adjacent parcels. The western parcel is approximately 2.05 acres in size and is currently zoned I-1, Industrial in Larimer County. The eastern parcel is approximately 2.82 acres in size and is currently zoned I, Industrial in Larimer County. The petitioner requests that the subject property (both parcels) be annexed and zoned I, Industrial in the City of Fort Collins. The proposed Resolution determines that the annexation petition complies with the Municipal Annexation Act. The Resolution also determines that a hearing should be established regarding the annexation and directs that notice be given of the hearing. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on April 21, 1998. The property is located within the Fort Collins Urban Growth Area. According to agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, (specifically Policy 2.1 Oc) the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. The property has 1,951.97 feet of its total 3,656.61 feet boundary contiguous to existing City limits, exceeding the minimum of 609.44 feet required to achieve 1/6th contiguity. Planning and Zoning Board Recommendation: The Planning and Zoning Board will conduct a public hearing on the annexation and zoning request at its regular semi-monthly meeting on March 19, 1998, and will make its recommendation at that time. The Board's recommendation will be forwarded to the City Council in time for the First Reading of the ordinances annexing and zoning the area, scheduled for April 21. 1998.
