FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
The uses on this site are permitted in the C - Commercial zoning district subject
to administrative review.
2. The application meets the land development standards of Division 4.17 of the
Land Use Code, the C - Commercial zoning district.
3. The application complies with the applicable standards of Section 3.3.1 of the
Land Use Code, Plat Standards.
4. There is no new land development or construction associated with this request,
therefore, other standards contained in the Land Use Code do not apply.
DECISION
Based on the findings and conclusions, the request to replat a portion of Tract 1 of the
ST. Wain Subdivision, specifically a subdivision of the University National Plaza,
located at 2020 South College Avenue, into two lots, file #4-98 is APPROVED.
Dated this 12th day of March, 1998, per authority granted by Sections 1.4.9(E) and 2.1
of the Land Use Code.

BACKGROUND
This application is a replat of a part of Tract 1 of the ST. Wain Subdivision which was
approved in 1964. Specifically, it is a subdivision of the University National Plaza,
located at 2020 South College Avenue, into two lots for the purpose of conveying a
portion of the center to another party for separate ownership. The site is 0.93 acres in
size and is located on the east side of South College Avenue, south of spring Creek
Drive and west of Remington Street. There is no new land development or construction
associated with this request.
The replat has been reviewed against the criteria of Section 3.3.1 of the Land Use
Code, Plat Standards. Specifically, the review criteria is contained in Sections 3.3.1(B),
lots, and 3.3.1(C), Public Sites, Reservations and Dedications.
Section 3.3.1(B)(1) states that no lot in a subdivision shall have less area than required
under the applicable zoning requirements: each lot must have vehicular access to a
public street; lots with both front and rear frontage on a street are not permitted with
limited exception; and, side lot lines must be at right angles or radial to street lines.
There are no minimum lot sizes in the C - Commercial zoning district (for
informational purposes, the two proposed lots are 13,327 and 27,257 square
feet). Each of the two lots have access to public streets, one to South College
and one to Remington.
Section 3.3.1(13)(2) states that the general layout of lots, roads, driveways, utilities,
drainage facilities and other services must be designed in a way that enhances an
interconnected street system, preserves natural areas and features and otherwise
accomplishes the purposes and intent of the Land Use Code.
Each of the lots have frontage and access on a public street which in turn
connects the site to the existing street system in and around the immediate area.
Section 3.3.2(C)(1) requires the dedication of rights -of -way for public streets, drainage
easements and utility easements as needed to serve the platted area.
Additional street right-of-way is not needed with this application. Additional land
for public utilities is being dedicated with this subdivision.
NOTICE OF PUBLIC HEARING: Notice of public hearing was made on February 24,
1998 by mailing to property owners within 500 feet of
the subject property.
The public hearing was advertised in the Coloradoan
on March 2, 1998.
PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 4:00 PM on March 11, 1998. The hearing was held in
Conference Room A at 281 North College, Fort Collins, Colorado.
