As the owner of the Subject Property, I am aware that East Avenue Development, LLC is proposing land
and building improvements that include a temporary construction easement, drainage easement and
public access easement on my parcel that is adjacent to their planned Home2 Suites Hotel by Hilton.
Being informed as such, Colorado Timberline, L.L.C. is agreeable to entertain negotiation
of these easements with East Avenue Development, LLC in the coming months, once the language and
terms of said easement are acceptable by Colorado Timberline, L.L.C. East Avenue
Development, LLC and the City of Fort Collins.

During the PDP process and following the Hearing approval, we have been in contact with various
City Departments and PFA, in an attempt to understand the exact configurations of the on -site and
off -site easements needed for approvals on the Home2 Suites project. Our client has supplied the
executed Letters -of -Intent documents (attached) from the Texas Roadhouse and Cinemark, which
accompany the following Easement Exhibits; those easements that we understand to be necessary
for project approvals. Our intent is to solicit feedback from reviewing departments and PFA as to
agreement, prior to drawing up and executing legal easements.
Please, provide information on whether the Easement Exhibits attached satisfy the necessary
easement requirements or in what way they need to be amended. We look forward to hearing your
