COLLEGE - PDP/FDP - 20-98 - DECISION - FINDINGS, CONCLUSIONS & DECISIONFINDINGS, CONCLUSIONS AND DECISION FINDINGS AND CONCLUSIONS After reviewing the staff report and the record of the public hearing, the Hearing Officer makes the following findings and conclusions: 1. The Will Subdivision PDP development proposal includes permitted uses consistent with Section 4.18 of the Land Use Code (CN - Commercial, North College Zoning District. 2. The Will Subdivision PDP development proposal complies with the specific development criteria contained in Section 4.18 of the Land Use Code (CN - Commercial, North College Zoning District), including those referenced in the Standards and Guidelines for the North College Avenue Corridor. 3. The Will Subdivision PDP development proposal meets all applicable General Development Standards from the Land Use Code. 4. The Will Subdivision PDP development proposal is compatible with surrounding land uses. DECISION Based on the findings and conclusions, the request to subdivide property at 742 - 746 North College Avenue and remodel the existing building, file #20-98 is APPROVED. Blanchard, AICP Current Planning Director d ocfikhea rings\20-98. h rg BACKGROUND This is a Project Development Plan (PDP) to subdivide property at 742 - 746 North College Avenue, remodel the existing building and bring the property into compliance with the provisions of the City of Fort Collins' Land Use Code. The building has been in existence for several years operating as different restaurants - most recently as Dimmer's Brew Pub. This proposal includes remodeling the building for retail uses. This proposal was reviewed against the criteria of Division 4.18 of the Land Use Code (the CN - Commercial, North College Zoning District) and the All Development Criteria contained in Article 3 of the Code. Retail is a permitted use int he CN zoning district. All development in the CN zoning district is also required to comply with the standards in the Standards and Guidelines for the North College Avenue Corridor to the extent possible. Staff review has indicated compliance with these regulations. Three specific sections from Article 3, General Development Standards, warrant special notice: Section 3.2.1, Landscaping and Tree Protection Standards, Section 3.2.2, Access, Circulation and Parking Standards, and, 3.5.1, Building and Project Compatibility Standards. Section 3.2.1 - Landscaping and Tree Protection Standards This project meets the requirements by providing a mix of shade and ornamental street trees between the curb and detached sidewalk along North College Avenue and providing interior parking lot landscaping equating to approximately 10% of the parking lot area. Section 3.2.2 - Access. Circulation and Parking Standards This project meets the requirements of this section by providing unobstructed vehicular access to and from a public street (this project has improved what was previously unrestricted access to the property to a clearly defined, shared drive on the north boundary of the property) and providing parking (20 spaces) within the allowed maximum (31 spaces). 3.5.1 - Building and Project Compatibility Standards This project meets the requirements of this section by maintaining the front building facade facing North College Avenue and retaining the height and scale of the existing building along with facade and roofing materials. NOTICE OF PUBLIC HEARING: Notice of public hearing was made on June 30, 1998 by mailing to property owners within 500 feet of the subject property. The public hearing was advertised in the Coloradoan on July 14, 1998. PUBLIC HEARING After reviewing the Staff Report and recommendation, a public hearing was held on the subject application at 3:30 PM on July 14, 1998. The hearing was held in the Maple Tree Conference Room at 281 North College Avenue, Fort Collins, Colorado. The property is located on the east side of North College Avenue, north of East Vine Drive and the Lake Canal Ditch and south of the Import Auto Sales. The property has an existing 7,785 square foot, 2 story building on site which will be remodeled for retail use.
