This letter is to confirm the intent of the Marjorie C Lynch Marital Trust, owner of the
above described unimproved lot to grant a grading easement for development in favor of Lot 19,
Prospect Industrial Park FTC_
It appears that the grading required for development of Lot 19 will not adversely effect
Lot IS and that it will be possible to negotiate a 6' wide slope easement adjacent to the project
prior to approval of the Final Development Plans. Any easement agreement is subject to the
approval of Lot 18 owner's engineer, surveyor and attorney and will include, but is not limited
to, the following conditions:
1. Reciprocal cooperation and support of the development of Lot IS.
2. Proof of liability and Workers Compensation insurance during development
activities.
3. Notice of any damage adverse effect to Lot 18,
4. Agreement not to enter, store equipment or otherwise conduct activities on Lot 18
not directly related to the activity of grading.
5. Hold Harmless during tho development of Lot 19.
6. Re-vegitation (seeding, etc.) of the disturbed portions of Lot 18.
7. Acceptable quality fill and compaction.
8. Self extinguishment upon the completion of development of Lot 18.
9. Payment of all expenses.

Here is the second letter of intent for the project. As far as I know, this is the last thing we need for the hearing to
be scheduled.
